{"id":21810,"date":"2012-07-17T12:29:48","date_gmt":"2012-07-17T06:59:48","guid":{"rendered":"https:\/\/www.legalindia.in\/news\/?p=21810"},"modified":"2012-07-17T12:29:48","modified_gmt":"2012-07-17T06:59:48","slug":"trial-against-kobad-ghandy","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/news\/trial-against-kobad-ghandy","title":{"rendered":"Trial against Kobad Ghandy"},"content":{"rendered":"<p><span style=\"color: #800000;text-decoration: underline\"><strong>Kobad Ghandy<\/strong><\/span> a top naxal leader to face trial as a Delhi court on Monday framed charges against him who being a member of a banned terror outfit and furthering its activities in violation of the <span style=\"color: #800000;text-decoration: underline\"><strong>Unlawful Activities Prevention Act<\/strong><\/span>.<\/p>\n<p><strong>\u00a0<span style=\"color: #800000;text-decoration: underline\">Additional Sessions Judge Pawan Kumar Jain<\/span><\/strong> charged Ghandy under <span style=\"color: #800000;text-decoration: underline\"><strong>Section 20 and 38 of UAPA<\/strong><\/span> relating to membership of the banned outfit, CPI-Maoist and furthering its activities.<\/p>\n<p>\u00a0The court framed the charges on a fresh charge sheet filed by the <span style=\"color: #800000;text-decoration: underline\"><strong>Special Cell of Delhi Police<\/strong><\/span> with a fresh sanction for his prosecution under the provisions of UAPA.<\/p>\n<p>\u00a0The fresh charge sheet was filed after ASJ had on March 28 absolved Kobad\u00a0Ghandy of terror charges for the want of proper sanction, despite noting that a case was made out against him under the anti-terror law as he was <span style=\"color: #800000;text-decoration: underline\"><strong>&#8220;not a mere sympathiser&#8221;<\/strong><\/span> of the banned outfit CPI (Maoist), but an active member.<\/p>\n<p>\u00a0Kobad Ghandy was then charged only for allegedly committing cheating forgery and impersonation.<\/p>\n<p><em>\u00a0<span style=\"text-decoration: underline\">&#8220;I am of the considered opinion that there is sufficient material on record to make out a prima-facie case for the offence punishable under Section 20 and 38 (member of banned outfit and furthering its activities) of Unlawful Activities (Prevention) Act (UAPA) against accused Kobad Ghandy&#8221;.<\/span><\/em><\/p>\n<p>\u00a0&#8220;<span style=\"text-decoration: underline\"><em>But since, the cognisance order dated February 19, 2010, qua the offences punishable under UAPA was not in accordance with the mandatory provisions of the UAPA, I hereby discharge accused Kobad Ghandy for the offences punishable under Section 10\/13\/18\/20\/38 of the UAPA,&#8221;<\/em><\/span> the ASJ had then said.<\/p>\n<p>\u00a0The trial in the matter will start from September 4.<\/p>\n<p>\u00a0An alumni of the prestigious Doon School, Ghandy was said to be part of the top leadership of erstwhile CPI-ML (People&#8217;s War Group) from 1981 and allegedly continued as a Central Committee member in CPI (Maoist) and was elected to its Politburo in 2007.<\/p>\n<p>\u00a0He was arrested by the Special Cell of Delhi police for allegedly trying to set up a base for banned outfit CPI (Maoist) in the national capital.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kobad Ghandy a top naxal leader to face trial as a Delhi court on Monday framed charges against him who being a member of a banned terror outfit and furthering its activities in violation of the Unlawful Activities Prevention Act. \u00a0Additional Sessions Judge Pawan Kumar Jain charged Ghandy under Section 20 and 38 of UAPA [&hellip;]<\/p>\n","protected":false},"author":21,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"jetpack_post_was_ever_published":false,"_jetpack_newsletter_access":"","_jetpack_dont_email_post_to_subs":false,"_jetpack_newsletter_tier_id":0,"_jetpack_memberships_contains_paywalled_content":false,"_jetpack_memberships_contains_paid_content":false,"footnotes":"","jetpack_publicize_message":"","jetpack_publicize_feature_enabled":true,"jetpack_social_post_already_shared":false,"jetpack_social_options":{"image_generator_settings":{"template":"highway","default_image_id":0,"font":"","enabled":false},"version":2}},"categories":[1],"tags":[10539,10540,229,381,10536,10537,10538,10541,7001],"class_list":["post-21810","post","type-post","status-publish","format-standard","hentry","category-top-law-news","tag-cpi-maoist","tag-cpi-ml","tag-delhi","tag-delhi-police","tag-kobad-ghandy","tag-kobad-ghandy-a-top-naxal-leader","tag-special-cell-of-delhi-police","tag-trial-against-kobad-ghandy","tag-unlawful-activities-prevention-act"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.4 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\n<title>Trial against Kobad Ghandy - Legal News India - Supreme Court &amp;
