{"id":21932,"date":"2012-07-20T18:53:10","date_gmt":"2012-07-20T13:23:10","guid":{"rendered":"https:\/\/www.legalindia.in\/news\/?p=21932"},"modified":"2012-07-20T18:53:10","modified_gmt":"2012-07-20T13:23:10","slug":"hc-frowns-on-new-rule-in-pcpndt-act","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/news\/hc-frowns-on-new-rule-in-pcpndt-act","title":{"rendered":"HC frowns on new rule in PCPNDT Act"},"content":{"rendered":"<p style=\"text-align: left\">The <span style=\"color: #800000\"><strong><span style=\"text-decoration: underline\">Bombay High Court<\/span><\/strong><\/span> today temporarily stayed a new rule introduced in the <span style=\"color: #800000;text-decoration: underline\"><strong>Pre Conception and Pre Natal Diagnostic Act<\/strong><\/span> (PCPNDT) barring radiologists from practising in more than two clinics in a district.<\/p>\n<p style=\"text-align: left\">\u00a0\u00a0The rule in PCPNDT\u00a0was introduced by the Centre in June and the Maharashtra government started implementing it from July 1.<\/p>\n<p style=\"text-align: left\"><strong>\u00a0<span style=\"color: #800000;text-decoration: underline\">\u00a0&#8220;We fail to understand the rationale behind the rule,&#8221;<\/span><\/strong> a division bench of <span style=\"color: #800000;text-decoration: underline\"><strong>Chief Justice Mohit Shah and Justice N M Jamdar<\/strong><\/span> said while staying the rule.\u00a0\u00a0The bench was hearing a petition filed by city radiologist Rajeev Zavkar stating that in 2002 he opened his own clinic in suburban Mahim and at the same time had also been practising in three other centres.<\/p>\n<p style=\"text-align: left\">\u00a0\u00a0According to Zavkar, the amendment to the PCPNDT\u00a0act curbs his right to practise his profession.
