{"id":21959,"date":"2012-07-22T14:13:41","date_gmt":"2012-07-22T08:43:41","guid":{"rendered":"https:\/\/www.legalindia.in\/news\/?p=21959"},"modified":"2012-07-22T14:14:29","modified_gmt":"2012-07-22T08:44:29","slug":"hc-exempts-scribe-employer-from-appearance-in-defamation-case","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/news\/hc-exempts-scribe-employer-from-appearance-in-defamation-case","title":{"rendered":"HC exempts scribe, employer from appearance in defamation case"},"content":{"rendered":"<p>A journalist has been exempted by the <span style=\"color: #800000;text-decoration: underline\"><strong>Delhi High Court<\/strong><\/span> from appearing personally before a trial court adjudicating the complaints of two former municipal councillors, accusing him of defaming them.\u00a0The<span style=\"color: #800000;text-decoration: underline\"><strong> journalist<\/strong><\/span>, working with media house<span style=\"color: #800000;text-decoration: underline\"><strong> Cobra Post<\/strong><\/span>, faces<span style=\"color: #800000;text-decoration: underline\"><strong> criminal defamation<\/strong> <\/span>complaint for purportedly exposing, through a sting operation, the two former councillors demanding bribe for allowing illegal constructions in their areas.<\/p>\n<p><strong>\u00a0<span style=\"color: #800000;text-decoration: underline\">Justice Manmohan<\/span><\/strong> exempted the journalist and its employer Cobra Post from personal appearance before the trial court, but made it clear that they would have to appear before it through their counsel.<\/p>\n<p>The high court&#8217;s interim order came on two separate pleas by Cobra Post and its reporter <span style=\"color: #800000;text-decoration: underline\"><strong>Kumar Ashish<\/strong><\/span>, seeking quashing of the criminal defamation complaint against them.\u00a0On their pleas, the high court also issued notices to the Delhi government and former councillors <span style=\"color: #800000;text-decoration: underline\"><strong>Ajit Singh Tokas and Ravi Prakash Sharma<\/strong><\/span> and sought their responses by August 9.<\/p>\n<p>\u00a0&#8220;<span style=\"text-decoration: underline\"><em>Notice issued to all respondents. The petitioners are exempted from personal appearance, however, (are) directed to appear through their counsel before the trial court.
