{"id":21970,"date":"2012-07-24T12:02:16","date_gmt":"2012-07-24T06:32:16","guid":{"rendered":"https:\/\/www.legalindia.in\/news\/?p=21970"},"modified":"2012-07-24T12:02:16","modified_gmt":"2012-07-24T06:32:16","slug":"bombay-high-court-there-is-difference-between-impotency-and-infertility","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/news\/bombay-high-court-there-is-difference-between-impotency-and-infertility","title":{"rendered":"Bombay High court: There is difference between impotency and infertility"},"content":{"rendered":"<p><span style=\"color: #800000;text-decoration: underline\"><strong>Bombay High court<\/strong><\/span> observed that there is a marked difference between <span style=\"color: #800000\"><strong>&#8216;infertility&#8217; and &#8216;impotency&#8217;<\/strong><\/span>, and set aside a 1994 order of divorce.<\/p>\n<p>\u00a0The family court, in October 1994, had granted divorce to the husband (then 42 years old) on the ground that the wife (then 45 years old) was impotent, a valid ground for divorce as contemplated by <span style=\"color: #800000;text-decoration: underline\"><strong>Section 12 (1) (a) of Hindu Marriage Act<\/strong><\/span>.<\/p>\n<p>\u00a0The wife challenged the divorce order in High Court.<\/p>\n<p>\u00a0The division bench of <span style=\"color: #800000;text-decoration: underline\"><strong>Justices A M Khanwilkar and A R Joshi<\/strong> <\/span>today set aside the divorce, observing that family court had erred in equating infertility with impotency.<\/p>\n<p>\u00a0<span style=\"text-decoration: underline\"><em>&#8220;The family court held that inability to give birth to a child presupposed that woman is impotent. This view taken by the family court is erroneous and it is wrong in accepting infertility of a woman equivalent to her impotency,&#8221;<\/em><\/span> the bench said.<\/p>\n<p>\u00a0The family court had said that even after 16 years of marriage, there was no child, which was sufficient to establish that wife was impotent.<\/p>\n<p>\u00a0<span style=\"text-decoration: underline\"><em>&#8220;We must say that the family court has definitely committed an error in arriving at such a conclusion and treating impotency and infertility at par.
