{"id":22050,"date":"2012-07-26T14:38:33","date_gmt":"2012-07-26T09:08:33","guid":{"rendered":"https:\/\/www.legalindia.in\/news\/?p=22050"},"modified":"2012-07-26T14:46:31","modified_gmt":"2012-07-26T09:16:31","slug":"n-d-tiwari-files-appeal-against-order-to-open-his-dna-report-in-hc","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/news\/n-d-tiwari-files-appeal-against-order-to-open-his-dna-report-in-hc","title":{"rendered":"N D Tiwari files appeal against order to open his DNA report in HC"},"content":{"rendered":"<p>Veteran Congress leader <span style=\"color: #800000;text-decoration: underline\"><strong>N D Tiwari<\/strong> <\/span>moved the Delhi High Court on Thursday against its single judge&#8217;s order to open his DNA report on Thursday to decide the <span style=\"color: #800000;text-decoration: underline\"><strong>paternity suit<\/strong> <\/span>of a youth claiming to be his biological son.<\/p>\n<p>\u00a0In his appeal, 87-year-old\u00a0 N D Tiwari has pleaded with the court to protect his<span style=\"color: #800000;text-decoration: underline\"><strong> &#8220;right to reputation,&#8221;<\/strong><\/span> contending that the single-judge bench has adopted a &#8220;shortcut&#8221; to decide the suit and it would cause <span style=\"color: #800000;text-decoration: underline\"><strong>&#8220;grave injustice&#8221;<\/strong><\/span> to him.<\/p>\n<p><span style=\"color: #800000;text-decoration: underline\"><strong>\u00a0&#8220;The single judge failed to appreciate that in a civil dispute, where the undisputed position of the parties is that no criminality is involved, the appellant&#8217;s (Tiwari) right to reputation has to be protected,&#8221;<\/strong><\/span> said Tiwari citing the Supreme Court&#8217;s May 24 order.&#8221;<span style=\"color: #800000;text-decoration: underline\"><strong>The single judge failed to appreciate that evolving a shortcut to decide the pending suit would result in grave injustice to the appellant and his fundamental right to avail the procedure established by law like any other citizen would be prejudiced and would result in irreparable damage,&#8221;<\/strong> <\/span>the plea said, while seeking the bench to quash the single judge&#8217;s July 20 order.<\/p>\n<p>\u00a0He further said, &#8220;<span style=\"text-decoration: underline\"><em>Rohit Shekhar (the petitioner in paternity suit) and his mother are leaving no stone unturned to get the report unsealed and make it public to attract undue media attraction without completion of the trial.&#8221;<\/em><\/span><\/p>\n<p>\u00a0The single judge had dismissed N D\u00a0Tiwari&#8217;s plea against making public his DNA report saying the apex court&#8217;s order to maintain confidentiality was for the purpose of collection of his blood sample for the DNA test and the transmission of the report to the high court but not for the purpose of trial.<\/p>\n<p><span style=\"color: #800000;text-decoration: underline\"><strong>&#8220;You cannot misinterpret the Supreme Court order. It was for the purpose of collection of blood sample for DNA test..,&#8221;<\/strong><\/span> the judge had said adding that the DNA report will be opened on July 27.<\/p>\n<p>\u00a0A former Andhra Pradesh Governor, N D\u00a0Tiwari earlier had filed an application before the single judge for keeping the DNA report confidential and holding in-camera proceedings in the case, saying that the Supreme Court had given such a direction on May 24.<\/p>\n<p>N D Tiwari had given blood sample for the DNA test on May 29 at his residence in Dehradun following the apex court order in the case, after repeatedly contesting against undertake the test on various grounds.<\/p>\n<p>N D\u00a0Tiwari&#8217;s pleas were objected to by 32-year-old Delhi youth <span style=\"color: #800000;text-decoration: underline\"><strong>Rohit Shekhar<\/strong><\/span>, who had filed the paternity suit in 2008, claiming the veteran Congress leader to be his biological father.
