{"id":22177,"date":"2012-07-30T18:42:22","date_gmt":"2012-07-30T13:12:22","guid":{"rendered":"https:\/\/www.legalindia.in\/news\/?p=22177"},"modified":"2012-07-30T18:42:22","modified_gmt":"2012-07-30T13:12:22","slug":"restrictive-trade-practices-cci-imposes-penalty-on-shree-cement","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/news\/restrictive-trade-practices-cci-imposes-penalty-on-shree-cement","title":{"rendered":"Restrictive Trade Practices: CCI imposes penalty on Shree Cement"},"content":{"rendered":"<p>In a case of restrictive trade practices the <span style=\"color: #800000; text-decoration: underline;\"><strong>Competition Commission of India(CCI)<\/strong><\/span> has imposed a penalty of Rs. 397.51 crore on Shree Cement \u00a0while issuing final order in the case against cement manufacturers and their trade body<span style=\"color: #800000; text-decoration: underline;\"><strong> Cement Manufacturers Association (CMA).<\/strong><\/span><\/p>\n<p>The CCI said <span style=\"text-decoration: underline;\"><em>\u201cThe Commission has also imposed a penalty on Shree Cement Ltd at the rate of 0.5 times of its profits for the years 2009-10 and 2010-11 aggregating to Rs. 397.51 crores\u201d.<\/em><\/span><\/p>\n<p>It further said<span style=\"color: #800000; text-decoration: underline;\"><strong>, \u201cfound eleven cement manufacturers, including Shree Cement Limited and CMA in contravention of the provisions of the Competition Act, 2002, which deal with\u00a0CCI including cartels\u201d.<\/strong><\/span><\/p>\n<p>The CCI also cautioned the company to refrain from such anti-competitive activities in the future.<\/p>\n<p>With regard to other companies, the CCI said as they were fined earlier, it was not imposing any penalty on them again for the same period of contravention.<\/p>\n<p>CCI last month had imposed penalty on several companies of \u00a0a whopping Rs. 6,307 crore on 11 leading cement makers, which includes <span style=\"color: #800000;\"><strong>\u00a0ACC, Ambuja Cements, UltraTech, India Cements, Binani Cement, JK Cement, Madras Cement, LaFarge and Jaypee Cement. Industry body CMA was also fined with Rs. 73 lakh.<\/strong><\/span><\/p>\n<p>The inquiry, the CCI statement said, was based on a case which was transferred from the Office of the Director General (Investigation &amp; Registration) of the erstwhile Monopolies and <span style=\"color: #800000; text-decoration: underline;\"><strong>Restrictive Trade Practices Commission<\/strong><\/span> to the CCI.<\/p>\n<p>The <span style=\"color: #800000; text-decoration: underline;\"><strong>MRTP Commission<\/strong><\/span> had initiated the investigations on a letter of Builders Association of India as well as on the basis of press reports published in a business daily.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>In a case of restrictive trade practices the Competition Commission of India(CCI) has imposed a penalty of Rs. 397.51 crore on Shree Cement \u00a0while issuing final order in the case against cement manufacturers and their trade body Cement Manufacturers Association (CMA).
