{"id":22223,"date":"2012-08-01T15:55:50","date_gmt":"2012-08-01T10:25:50","guid":{"rendered":"https:\/\/www.legalindia.in\/news\/?p=22223"},"modified":"2012-08-01T16:01:06","modified_gmt":"2012-08-01T10:31:06","slug":"hc-notice-on-st-stephens-principals-appointment","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/news\/hc-notice-on-st-stephens-principals-appointment","title":{"rendered":"HC notice on St. Stephens principal&#8217;s appointment"},"content":{"rendered":"<p>A single judge order that upheld the appointment of <span style=\"color: #800000; text-decoration: underline;\"><strong>Valson Thampu<\/strong><\/span> as the principal of<span style=\"color: #800000; text-decoration: underline;\"><strong> St. Stephens college<\/strong><\/span> has been challenged in the the Delhi High Court. <span style=\"color: #800000; text-decoration: underline;\"><strong>The Delhi High Court<\/strong><\/span> on Wednesday issued notices to Delhi University and St. Stephens College on the issue of appointment of Valson Thampu.<\/p>\n<p>\u00a0A division bench of <span style=\"color: #800000; text-decoration: underline;\"><strong>Acting Chief Justice A.K. Sikri and Justice Rajeev Sahai Endlaw<\/strong> <\/span>also issued notice to Thampu and sought responses by Oct 11.<\/p>\n<p>M.S. Frank, the former vice principal of St. Stephens, has challenged the single judge order of July 3, and alleged that Thampu was illegally holding the post of principal and did not have a valid PhD degree, the minimum qualification for the post of college principal.<\/p>\n<p><span style=\"color: #800000; text-decoration: underline;\"><strong>Justice Siddharth Mridul<\/strong><\/span> July 3 dismissed Frank&#8217;s petition, ruling that Thampu possessed the essential qualification for the post. He also refused to interfere with the decision taken by the experts who appointed Thampu.<\/p>\n<p>Justice Mridul in his order said,<span style=\"text-decoration: underline;\"><em> &#8220;The writ petition does not want any interference. The decision taken by the experts, namely the<\/em><\/span> <span style=\"color: #800000; text-decoration: underline;\"><strong>University Grant Commission<\/strong><\/span> <span style=\"text-decoration: underline;\"><em>and the Delhi University, to the effect that Valson Thampu possesses essential qualification for the post of principal of St. Stephens College is a decision which in my view ought to be left to experts rather than courts&#8221;.<\/em><\/span><\/p>\n<p>Frank said that Thampu holds a <span style=\"color: #800000;\"><strong>PhD in theology<\/strong><\/span> awarded by the <span style=\"color: #800000;\"><strong>Allahabad Agricultural University<\/strong><\/span>. But theology was not taught at Delhi University and the relevance of Thampu&#8217;s PhD for the post of principal was not certain.<\/p>\n<p>\u00a0However, the order had said that UGC had given clarification to the effect that the PhD degree awarded by the Allahabad Agricultural University was a valid degree.<\/p>\n<p>\u00a0Thampu was appointed principal of St. Stephens College on Sep 12, 2008.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A single judge order that upheld the appointment of Valson Thampu as the principal of St. Stephens college has been challenged in the the Delhi High Court.
