{"id":22243,"date":"2012-08-02T14:39:57","date_gmt":"2012-08-02T09:09:57","guid":{"rendered":"https:\/\/www.legalindia.in\/news\/?p=22243"},"modified":"2012-08-02T14:40:49","modified_gmt":"2012-08-02T09:10:49","slug":"kerala-hc-refuses-to-stay-ban-on-pan-masala","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/news\/kerala-hc-refuses-to-stay-ban-on-pan-masala","title":{"rendered":"Kerala HC refuses to stay ban on pan masala"},"content":{"rendered":"<p><span style=\"color: #800000; text-decoration: underline;\"><strong>Kerala High Court<\/strong><\/span> on Thursday refused to stay the state government&#8217;s ban on manufacture, storage and sale of gutka, pan masala and their variants containing tobacco and nicotine.<\/p>\n<p>Declining to stay the May 22 last government order invoking the provisions of <span style=\"color: #800000; text-decoration: underline;\"><strong>Food Safety and Standards Regulation Act, 2011<\/strong><\/span> to ban the products, Justice T R Ramachandran Nair said prima facie he found no reason to interfere with the order.<\/p>\n<p>However, the Kerala court directed the government to grant more time to remove stocks of the banned products from the state and asked it to issue a circular notifying the date for shifting the stock confiscated at various checkposts as well as in godowns of distributors.<\/p>\n<p>The order was issued on a batch of petitions by the manufacturers of panmasala and gutka products challenging the legality of the government order and seeking a stay on it.<span style=\"color: #800000; text-decoration: underline;\"><strong>Kerala Government<\/strong><\/span> had slapped the ban citing increasing incidence of diseases like oral cancer.<\/p>\n<p>Source: PTI<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court on Thursday refused to stay the state government&#8217;s ban on manufacture, storage and sale of gutka, pan masala and their variants containing tobacco and nicotine.
