{"id":22385,"date":"2012-08-07T13:20:47","date_gmt":"2012-08-07T07:50:47","guid":{"rendered":"https:\/\/www.legalindia.in\/news\/?p=22385"},"modified":"2012-08-07T13:20:47","modified_gmt":"2012-08-07T07:50:47","slug":"no-sanction-needed-for-cognisance-of-charge-sheet-cbi","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/news\/no-sanction-needed-for-cognisance-of-charge-sheet-cbi","title":{"rendered":"No sanction needed for cognisance of charge sheet: CBI"},"content":{"rendered":"<p><span style=\"color: #800000; text-decoration: underline;\"><strong>CBI<\/strong><\/span> on Monday said the special court, hearing the <span style=\"color: #800000; text-decoration: underline;\"><strong>Adarsh Society scam<\/strong><\/span>, did not need a government sanction to take<span style=\"color: #800000; text-decoration: underline;\"><strong> cognisance<\/strong> <\/span>of the charge sheet filed against former Maharashtra chief minister Ashok Chavan.<\/p>\n<p>\u00a0The agency&#8217;s statement came upon a query by the special CBI court. <span style=\"color: #800000; text-decoration: underline;\"><strong>Special Public Prosecutor Ejaz Khan<\/strong><\/span> argued that no sanction was needed as Chavan was now only an MLA.<\/p>\n<p><span style=\"color: #800000; text-decoration: underline;\"><strong>\u00a0&#8220;Offences were allegedly committed when Chavan was a minister but now, when the matter is for taking cognisance, he is not a minister,&#8221;<\/strong> <\/span>he argued.<\/p>\n<p>\u00a0There was no legal impediment even otherwise as the <span style=\"color: #800000; text-decoration: underline;\"><strong>Bombay High Court<\/strong><\/span>, which is hearing two PILs on Adarsh case, had not stayed the proceedings or passed any order of restraint, Khan said.<\/p>\n<p>\u00a0The special court today scheduled the next hearing for August 30. On July 4, CBI filed a 10,000-page charge sheet against 13 accused, including Chavan. CBI had started the probe in November 2010.<\/p>\n<p>\u00a0During the hearing of PILs, the Society as well as the Maharashtra government recently filed affidavits in the High Court, challenging the CBI&#8217;s jurisdiction.<\/p>\n<p>\u00a0The land on which Adarsh stands belonged to state and it had not sought the CBI probe, so the central agency had no jurisdiction, they said.<\/p>\n<p>\u00a0<span style=\"color: #800000; text-decoration: underline;\"><strong>Ministry of Defence<\/strong><\/span> has opposed the claim, saying ownership of the land was in dispute.
