{"id":22387,"date":"2012-08-07T13:48:30","date_gmt":"2012-08-07T08:18:30","guid":{"rendered":"https:\/\/www.legalindia.in\/news\/?p=22387"},"modified":"2012-08-07T13:50:33","modified_gmt":"2012-08-07T08:20:33","slug":"admission-policy-discretion-of-schools-mp-high-court","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/news\/admission-policy-discretion-of-schools-mp-high-court","title":{"rendered":"Admission policy discretion of schools: MP high court"},"content":{"rendered":"<p>The <span style=\"color: #800000; text-decoration: underline;\"><strong>Indore bench of the Madhya Pradesh high court<\/strong><\/span> has turned down admission of one <span style=\"color: #800000; text-decoration: underline;\"><strong>Ashima Baig<\/strong> <\/span>in Class VI of St Raphael&#8217;s school on the ground for failing to abide by the school norms.<\/p>\n<p>A division bench of <span style=\"color: #800000; text-decoration: underline;\"><strong>Justice Shantanu Kemkar and Justice Prakash Shrivastava<\/strong><\/span> passed the order on a writ appeal which challenged a single bench&#8217;s previous order directing the school to give admission to the student. The <span style=\"color: #800000; text-decoration: underline;\"><strong>single bench order<\/strong><\/span> came on a petition filed by the parents of the ward.<\/p>\n<p>In its order, the division bench quoted <span style=\"color: #800000; text-decoration: underline;\"><strong>article 12 of the constitution<\/strong><\/span> and ruled that the admission rights was in favour of<span style=\"color: #800000; text-decoration: underline;\"><strong> St Raphael school<\/strong> <\/span>and the admission policy remains the sole discretion of any institution and would not be affected or prejudiced by legal interventions.<\/p>\n<p><span style=\"text-decoration: underline;\"><em>&#8220;However, the parents may be allowed to approach the school management for consideration but the school reserves the right to accept or reject it,&#8221;<\/em><\/span> the order said.<\/p>\n<p>Source: TOI<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Indore bench of the Madhya Pradesh high court has turned down admission of one Ashima Baig in Class VI of St Raphael&#8217;s school on the ground for failing to abide by the school norms.
