{"id":22838,"date":"2012-08-28T12:10:47","date_gmt":"2012-08-28T06:40:47","guid":{"rendered":"https:\/\/www.legalindia.in\/news\/?p=22838"},"modified":"2012-08-28T12:10:47","modified_gmt":"2012-08-28T06:40:47","slug":"cheque-bounce-case-court-acquits-kanda-brother","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/news\/cheque-bounce-case-court-acquits-kanda-brother","title":{"rendered":"Cheque bounce case: Court acquits Kanda, brother"},"content":{"rendered":"<div id=\"arti_content_n\">\n<p><span style=\"font-family: Arial; font-size: small;\">Former Haryana Minister Gopal Goyal Kanda, arrested in ex-air hostess Geetika Sharma suicide case, and his brother were on Monday acquitted by a Delhi court in a 14-year-old cheque bounce case as they settled the matter with the complainant by paying Rs 4.10 lakh.<\/span><\/p>\n<div id=\"ad_in_arti\"><a href=\"https:\/\/ads.rediff.com\/5c\/innewsA.rediff.com\/news-article.htm\/1421676825\/x15\/default\/empty.gif\/65447454335641385a7277414363665a\" target=\"_top\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" src=\"https:\/\/i0.wp.com\/imads.rediff.com\/0\/default\/empty.gif?resize=1%2C1&#038;ssl=1\" alt=\"\" width=\"1\" height=\"1\" border=\"0\" \/><\/a><\/div>\n<p><span style=\"font-family: Arial; font-size: small;\">&#8220;In view of the statement of the AR (authorised representative) of the complainant, the present case is disposed of as compromised and the accused (Kanda and his <\/span><span style=\"font-family: Arial; font-size: small;\">brother Gobind) are acquitted&#8230;,&#8221; Metropolitan Magistrate <\/span><span style=\"font-family: Arial; font-size: small;\">Vikrant Vaid said.<\/span><\/p>\n<p><span style=\"font-family: Arial; font-size: small;\">During the hearing, the representative of complainant M\/s <\/span><span style=\"font-family: Arial; font-size: small;\">Indo Polycoats Pvt Ltd told the court that the dispute has been settled and the case be allowed to be withdrawn. The plea was allowed.<\/span><\/p>\n<p><span style=\"font-family: Arial; font-size: small;\">The counsel for the complainant, Dharmender Priani, said that nothing remained as the matter has been amicably settled and the accused have already paid outstanding Rs 4.10 lakh to the firm.<\/span><\/p>\n<p><span style=\"font-family: Arial; font-size: small;\">The court was hearing a cheque bounce case against Gobind and Gopal lodged on the complaint of Indo Polycoats Pvt Ltd, engaged in manufacturing of coated fabrics and vinyl flooring.<\/span><\/p>\n<p><span style=\"font-family: Arial; font-size: small;\">In August 1997, the complainant had got a request from <\/span><span style=\"font-family: Arial; font-size: small;\">Kandas&#8217; company &#8211;Kanda Polymers &#8212; in August 1997, for supply for coated fabrics to them. <\/span><\/p>\n<p><span style=\"font-family: Arial; font-size: small;\">Two cheques of Rs 2 lakh and 2.10 lakh were issued by accused Gobind, as authorised signatory of the firm, in the name of the complainant firm and a case under the Negotiable Instruments Act was filed against them as the cheques got dishonoured due to &#8220;insufficient&#8221; balance.<\/span><\/p>\n<p><span style=\"font-family: Arial; font-size: small;\">Kanda brothers, who were declared proclaimed offenders last year after they did not appear before the court, got arrested only after the magisterial court on August 16 had issued non-bailable warrant against Gopal Kanda in connection with the suicide of 23-year-old air hostess Geetika Sharma.<\/span><\/p>\n<p><span style=\"font-family: Arial; font-size: small;\">Gobind got bail after being produced before the court on <\/span><span style=\"font-family: Arial; font-size: small;\">August 18.
