{"id":24763,"date":"2012-11-21T11:57:37","date_gmt":"2012-11-21T06:27:37","guid":{"rendered":"https:\/\/www.legalindia.in\/news\/?p=24763"},"modified":"2012-11-21T11:57:37","modified_gmt":"2012-11-21T06:27:37","slug":"4-ponty-chadhas-guards-remanded-to-police-custody","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/news\/4-ponty-chadhas-guards-remanded-to-police-custody","title":{"rendered":"4 Ponty Chadha&#8217;s guards remanded to police custody"},"content":{"rendered":"<p>Liquor baron Ponty Chadha&#8217;s four guards, who were arrested for allegedly entering a disputed farmhouse in south Delhi and thrashing some men there, were today remanded to five days of police custody by a Delhi court.<\/p>\n<p>The four persons identified as Bhupender, Rajpal, Uday and Anand were produced before Metropolitan Magistrate Sandeep Garg who sent them to police custody till November 25.<\/p>\n<p>&#8220;Investigation in the case is at the initial stage. The conspiracy behind the alleged incident is yet to be unearthed.<\/p>\n<p>According to the judge, &#8220;All the four accused persons are remanded to police custody for five days (November 25)&#8221;<\/p>\n<p>The four were arrested for allegedly entering a disputed farmhouse of Chadhas at Chhattarpur in south Delhi and thrashing Ponty&#8217;s younger brother Hardeep men on November 17, hours before the liquor baron was killed on the same spot, police told the court today.<\/p>\n<p>Police said the four accused were among a group of people who had entered the farmhouse, beat up the men of Hardeep, with whom Ponty had a dispute, and threw them out.<\/p>\n<p>The police had sought five days&#8217; remand saying other co-accused are yet to be arrested in the case and these four accused are to be confronted with the articles seized from the farmhouse.<\/p>\n<p>However, police remand of the four was opposed by their senior counsel K K Manan saying since the farmhouse, which the accused had allegedly trespassed into belongs to Ponty, they were unlikely to grab it.<\/p>\n<p>Manan said the case has been cooked up by the police as the person (Nand Lal, Hardeep&#8217;s car driver), on whose complaint FIR under various provisions of IPC including robbery, trespass, attempt to murder and kidnapping has been lodged against them, is false.<\/p>\n<p>Manan also said there are &#8220;glaring inconsistencies and contradictions&#8221; recorded in the present case and that there has been an inordinate delay in the registration of an FIR.<\/p>\n<p>He contended before the court that the present accused were picked up by the police on November 17 and the agency has also illegally detained 30 other persons from the farmhouse in which they allegedly trespassed.<\/p>\n<p>The police seeking remand told the court that a large number of other persons are also involved in this case and the alleged shootout between Ponty and Hardeep in which they died and their custodial interrogation is, therefore, required.<\/p>\n<p>This incident had preceded the shootout in the farmhouse in which Ponty and Hardeep were killed.<\/p>\n<p>The police had also told the court that among the four accused, three have been identified by the complainant Lal.<\/p>\n<p>The official also said Lal was kidnapped and shifted to Ponty&#8217;s farmhouse from were he escaped.<\/p>\n<p>Lal had lodged a case at Mehrauli police station in South Delhi about the alleged trespass of Ponty&#8217;s men in Hardeep&#8217;s farmhouse.<\/p>\n<p>The court has in its order also said the IO has failed to produce any evidence on record to establish the ownership of the farmhouse where the alleged incident took place.<\/p>\n<p>Meanwhile, another Delhi court has remanded to two days in police custody two other accused arrested for allegedly entering the disputed family farmhouse of the Chadhas in Bijwasan in south west Delhi by scaling its wall after breaking the locks.<\/p>\n<p>The police said the staff of Hardeep is now staying at the farmhouse and Ponty&#8217;s men had allegedly gone there on November 18 to capture the property by putting new locks.<\/p>\n<p>Metropolitan Magistrate Ruchika Singla sent accused Vijay Kumar and Madan Rana to police custody till tomorrow on the ground that the probe in the case is at a &#8220;preliminary stage&#8221;.<\/p>\n<p>&#8220;Keeping in mind the seriousness of the offence and also that the investigation is still at a preliminary stage, two days police custody is granted to the Delhi Police.<\/p>\n<p>&#8220;The two accused be produced after expiry of the police custody,&#8221; the court said.<\/p>\n<p>Kumar and Rana were arrested on November 18 for the offences under the IPC relating to wrongful restrain, trespass, preparation to hurt and criminal intimidation.<\/p>\n<p>The police had sought three days of police remand for the two accused on the ground that their other associates are still absconding and that the vehicles in which they had come to the farmhouse to commit the offence is still to be recovered. It also submitted the absconding accused belongs to Punjab.<\/p>\n<p>However, the police custody plea was opposed by the counsel for the accused.<\/p>\n<p>Meanwhile, 40-year-old accused Vijay Kumar also moved a bail plea in the court on the ground that he was arrested by the police with malafide intention.<\/p>\n<p>He also said in his application that he was working with the owner of the property and was supervising the farmhouse and so he cannot be arrested for the offence of trespass.<\/p>\n<p>The magistrate has kept the bail plea for tomorrow for consideration.<\/p>\n<p>&nbsp;<\/p>\n<p>By PTI<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Liquor baron Ponty Chadha&#8217;s four guards, who were arrested for allegedly entering a disputed farmhouse in south Delhi and thrashing some men there, were today remanded to five days of police custody by a Delhi court.
