A PIL has been dismissed by\u00a0the Madras High Court, seeking to quash Tamil Nadu government’s order extending the tenure of Director General of Police K Ramanujam for two more years from November 30.<\/p>\n

A Division Bench, comprising Justices V Ramasubramanian and M M Sundaresh, cited the Supreme Court judgement in the Prakash Singh case and upheld the government’s decision to extend his tenure.<\/p>\n

One M Suresh Kumar, in his PIL, contended that as per the apex court order, a state security commission should have been constituted, following which the DGP should have been appointed.<\/p>\n

He also contented that as per All India Service Rules, any person who has completed 60 years of age shall not continue in service<\/div>\n

The bench cited the verdict in Prakash Singh case and said though Clause 16(1) of the All India Service Rules did not allow it, the apex court verdict in that case against it remained the law of the land.<\/p>\n

On Kumar’s contention that UPSC had sent only one name as its recommendation for the post of DGP, as brought out in an RTI application, the bench said the state government had sent a list of three names and it was UPSC that had recommended one of those names.<\/p>\n

“In any case, a quo warranto cannot decide eligibility and suitability as its only grounds.. Who is fit and who is not fit cannot be decided as quo warranto,” the bench said.<\/p>\n

Tamil Nadu government had on November 5 last extended the tenure of Ramanujam as DGP for two more years.<\/p>\n
