In exercise of the powers conferred by section 37 of the Bureau of Indian Standards Act, 1986 (63 of 1986), the Central Govern\u00adment hereby makes the following rules, namely:\u2014<\/i><\/p>\n

Short title and commencement.<\/b><\/p>\n

1.\u00a0\u00a0\u00a0\u00a0(1) These rules may be called the Bureau of Indian Standards (Recognition
\nof Consumers Associations) Rules, 1991.<\/p>\n

(2) They shall come into force on the date of their publication in the Official Gazette.<\/p>\n

Definitions.<\/b><\/p>\n

2.\u00a0\u00a0\u00a0\u00a0In these rules, unless the context otherwise requires \u2014<\/p>\n

(a<\/i>)\u00a0\u00a0\u00a0\u201cAct\u201d means the Bureau of Indian Standards Act, 1986 ( 63 of 1986);<\/p>\n

(b<\/i>)\u00a0\u00a0\u00a0\u201cForm\u201d means a Form appended to the Schedule to these rules;<\/p>\n

(c<\/i>)\u00a0\u00a0\u00a0\u201cMinistry\u201d means the Ministry of Civil Supplies, Con\u00adsumer Affairs and Public Distribution; and<\/p>\n

(d<\/i>)\u00a0\u00a0\u00a0\u201cPrincipal Officer\u201d in relation to a consumer associa\u00adtion means any individual who is specifically authorised in writing or by means of a resolution adopted by such consumers\u2019 association in that behalf.<\/p>\n

Application for recognition of consumers\u2019 association.<\/b><\/p>\n

3.\u00a0\u00a0\u00a0\u00a0(1) Every consumers\u2019 association which is desirous of being recognised as
\na registered Consumers\u2019 Association \u2014<\/p>\n

(a<\/i>)\u00a0\u00a0\u00a0shall have not less than fifty consumers as its members; and<\/p>\n

(b<\/i>)\u00a0\u00a0\u00a0shall make an application for such recognition in triplicate to the Bureau of Indian Standards in Form I.<\/p>\n

(2) Every application made under sub-rule (1) shall be accompa\u00adnied by a bank draft of rupees one thousand.<\/p>\n

(3) On receipt of an application made under sub-rule (1), the Bureau of Indian Standards shall note thereon the date of its receipt and shall forthwith communicate such date to the appli\u00adcant.<\/b><\/td>\n<\/tr>\n

(4) The Bureau of Indian Standards may, before issue of a certif\u00adicate of recognition, require the applicant to furnish, within such period as may be specified by it, such additional informa\u00adtion as may be considered necessary within a period of 30 days of a receipt of that letter by the applicant.<\/p>\n

(5) On receipt of an application and such other additional infor\u00admation as may be sought under sub-rule (4), the Bureau of Indian Standards shall process the application and forward documents to the Ministry of Civil Supplies. Government of India with its recommendations for their consideration.<\/p>\n

(6) On receipt of the recommendations of the Bureau under sub-rule (5), the Ministry shall consider those recommendations and after satisfying itself that the applicants\u2019 association is fit to be recognised, may recognise the association in this behalf.<\/p>\n

(7) The certificate of recognition to be issued by the Ministry under sub-rule (6) shall be in Form II.<\/p>\n

(8) Where a certificate of recognition issued under these rules is lost, destroyed or mutilated, a duplicate may be issued on an application made in this behalf and on payment of a fee of rupees one hundred.<\/p>\n

Payment of fees.<\/b><\/p>\n

4.\u00a0\u00a0\u00a0\u00a0The fees payable under those rules shall be paid in the form of a bank draft
\nin favour of the Bureau of Indian Standards, New Delhi.<\/p>\n

Refusal to grant certificate of recognition to consumers\u2019 associ\u00adation.<\/b><\/p>\n

5.\u00a0\u00a0\u00a0\u00a0Where a certificate of recognition of a consumers\u2019 association has been
\nrefused, the applicant shall be informed of the reasons for such refusal by the Bureau.<\/p>\n

Copies of certificate of recognition to be furnished to certain authorities.<\/b><\/p>\n

6.\u00a0\u00a0\u00a0\u00a0Every consumers\u2019 association which has been recognised as a \u2018registered
\nconsumers\u2019 association under these rules shall fur\u00adnish a copy of the certificate of recognition issued to it while filing a complaint under section 35(1) of the Act.<\/p>\n

Verification of application.<\/b><\/p>\n

7.\u00a0\u00a0\u00a0\u00a0Every application made under these rules shall be duly veri\u00adfied by the
\nPrincipal Officer.<\/p>\n
