{"id":27536,"date":"2013-04-03T11:40:46","date_gmt":"2013-04-03T06:10:46","guid":{"rendered":"https:\/\/www.legalindia.in\/news\/?p=27536"},"modified":"2013-04-03T11:40:46","modified_gmt":"2013-04-03T06:10:46","slug":"sc-agrees-to-hear-mittals-plea-against-summons","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/news\/sc-agrees-to-hear-mittals-plea-against-summons","title":{"rendered":"SC agrees to hear Mittal&#8217;s plea against summons"},"content":{"rendered":"<p>The petition of the Bharti Airtel chairman\u00a0<a href=\"https:\/\/www.livemint.com\/Search\/Link\/Keyword\/Sunil%20Mittal\">Sunil Mittal<\/a>\u00a0 has been accepted by the Supreme Court to\u00a0challenging a special court\u2019s summons to him to appear before it as an accused in the 2G spectrum allocation case here in New Delhi.<\/p>\n<div>The bench headed by Chief Justice\u00a0<a href=\"https:\/\/www.livemint.com\/Search\/Link\/Keyword\/Altamas%20Kabir\">Altamas Kabir<\/a>\u00a0posted the matter to 8 April.<\/div>\n<div><\/div>\n<div>Special court judge\u00a0<a href=\"https:\/\/www.livemint.com\/Search\/Link\/Keyword\/O.P.%20Saini\">O.P. Saini<\/a>\u00a0had summoned Mittal to appear before him on 11 April on the grounds that as the head of\u00a0<a href=\"https:\/\/www.livemint.com\/Search\/Link\/Keyword\/Bharti\">Bharti<\/a><a href=\"https:\/\/www.livemint.com\/Search\/Link\/Keyword\/Airtel\">Airtel<\/a>\u00a0when the alleged irregularities in spectrum allocation happened, he was responsible for his company\u2019s actions and had knowledge of the allocation.<\/div>\n<div><\/div>\n<div>Saini has also summoned\u00a0<a href=\"https:\/\/www.livemint.com\/Search\/Link\/Keyword\/Essar%20Group\">Essar Group<\/a>\u00a0vice-chairman\u00a0<a href=\"https:\/\/www.livemint.com\/Search\/Link\/Keyword\/Ravi%20Ruia\">Ravi Ruia<\/a>, who was then a director in one of accused companies, Sterling Cellular Ltd, and\u00a0<a href=\"https:\/\/www.livemint.com\/Search\/Link\/Keyword\/Asim%20Ghosh\">Asim Ghosh<\/a>, then managing director of accused firm Hutchison Max Telecom Pvt. Ltd.<\/div>\n<div><\/div>\n<div>Their names were not mentioned in the chargesheet filed by the Central Bureau of Investigation that\u2019s probing the case. But Saini ruled that Mittal, Ruia and Ghosh were \u201cprima facie\u201d in \u201ccontrol of affairs\u201d of their companies.<\/div>\n<div><\/div>\n<div>\u201cAs such, they represented the directing mind and will of companies and their state of mind was that of the companies,\u201d the judge had said, adding, \u201cThey are\/were \u2018alter-ego\u2019 of their respective companies.\u201d<\/div>\n<div><\/div>\n<div>On 21 December, the CBI filed a chargesheet against former telecom secretary\u00a0<a href=\"https:\/\/www.livemint.com\/Search\/Link\/Keyword\/Shyamal%20Ghosh\">Shyamal Ghosh<\/a>\u00a0and Bharti, Hutchison and Sterling (now part of\u00a0<a href=\"https:\/\/www.livemint.com\/Search\/Link\/Keyword\/Vodafone%20India%20Ltd\">Vodafone India Ltd<\/a>), but didn\u2019t name any individuals.<\/div>\n","protected":false},"excerpt":{"rendered":"<p>The petition of the Bharti Airtel chairman\u00a0Sunil Mittal\u00a0 has been accepted by the Supreme Court to\u00a0challenging a special court\u2019s summons to him to appear before it as an accused in the 2G spectrum allocation case here in New Delhi.
