The Delhi High Court on Thursday refused to take back its earlier order restraining a photocopier at Delhi University campus from violating alleged copyright of three international publishing houses on certain text books by selling their photocopies to students.<\/p>\n
Justice Rajiv Sahai Endlaw did not allow the plea of students seeking lifting of the stay on selling of photocopies of certain text books, published by the University Press, the Cambridge University Press and Taylor and Francis. The offshore publishing houses had on August 14 last year moved the court against Rameshwari Photocopy Service located inside the DU campus alleging it was infringing their copyright over the text books.<\/p>\n
The court had then restrained Rameshwari Photocopy Service from \u201cmaking or selling course packs and also reproducing the plaintiff\u2019s publication or substantial portion by compiling the same either in a book form or in the form of a course pack till the final disposal of the said application.\u201d<\/p>\n
\u201cThe photocopier is running its shop under licence from the university. Photocopier has no right to compile such course packs and books\/articles published by the plaintiffs and more so when the university has<\/p>\n
taken a stand that that they have no intention to breach any law by making such reproductions as complained of by the plaintiff in the present suit,\u201d it had said.<\/p>\n
