{"id":34317,"date":"2014-07-20T16:53:21","date_gmt":"2014-07-20T11:23:21","guid":{"rendered":"https:\/\/www.legalindia.in\/news\/?p=34317"},"modified":"2014-07-20T16:53:21","modified_gmt":"2014-07-20T11:23:21","slug":"hc-turns-govt-plea-3-months-time-decide-sra-scheme","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/news\/hc-turns-govt-plea-3-months-time-decide-sra-scheme","title":{"rendered":"HC turns down govt plea for 3 months time to decide SRA scheme"},"content":{"rendered":"<p><span style=\"color: #000000;\">Observing that enough time had been given to\u00a0<\/span><a class=\"storyTags\" style=\"color: #0000ff !important;\" href=\"https:\/\/www.business-standard.com\/search?type=news&amp;q=Maharashtra\" target=\"_blank\">Maharashtra<\/a><span style=\"color: #000000;\">government to consider a proposal to amend the Slum Rehabilitation Authority (SRA) scheme in\u00a0<\/span><a class=\"storyTags\" style=\"color: #0000ff !important;\" href=\"https:\/\/www.business-standard.com\/search?type=news&amp;q=Thane\" target=\"_blank\">Thane<\/a><span style=\"color: #000000;\">, the Bombay High\u00a0<\/span><a class=\"storyTags\" style=\"color: #0000ff !important;\" href=\"https:\/\/www.business-standard.com\/search?type=news&amp;q=Court\" target=\"_blank\">Court<\/a><span style=\"color: #000000;\">\u00a0has refused to grant the state three months time to take a policy decision on the issue.\u00a0<\/span><br style=\"color: #000000;\" \/><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">However, the court granted a short time to the state till August 14 to comply with its earlier orders by taking a policy decision on a proposal forwarded to it by the Thane Municipal Corporation which envisages removal of technical hitches to ensure smooth implementation of the SRA scheme.\u00a0<\/span><br style=\"color: #000000;\" \/><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">The court noted that despite its earlier orders, the government had not taken decision on the issue for over a year and now it wanted three months more time to carry out the proposed amendment.\u00a0<\/span><br style=\"color: #000000;\" \/><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">&#8220;In the face of the orders of this court which we have quoted above, it is not possible to accept the request of the State Government to extend the time for a period of three months,&#8221; said a bench of justices\u00a0<\/span><a class=\"storyTags\" style=\"color: #0000ff !important;\" href=\"https:\/\/www.business-standard.com\/search?type=news&amp;q=Abhay+Oka\" target=\"_blank\">Abhay Oka<\/a><span style=\"color: #000000;\">\u00a0and A S Chandurkar in a recent order.\u00a0<\/span><br style=\"color: #000000;\" \/><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">The court warned that if the state did not take a policy decision on the issue by August 14, it would take up for hearing on August 19 a contempt petition filed by slum dwellers in Thane, who had challenged the SRA scheme and urged modification by the government to remove technical hitches.\u00a0<\/span><br style=\"color: #000000;\" \/><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">Until then, the hearing on the contempt petition will be kept pending, the judges noted.\u00a0<\/span><br style=\"color: #000000;\" \/><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">The state had filed an application on June 13 seeking three months time to take a policy decision to consider the proposal for modification of SRA scheme.\u00a0<\/span><br style=\"color: #000000;\" \/><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">Counsel for the petitioners opposed the application on the ground that such conduct on the part of the state Government makes a mockery of the court orders.\u00a0<\/span><br style=\"color: #000000;\" \/><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">The petitioners argued that there is every likelihood of &#8216;code of conduct&#8217; being applied in near future on account of the forthcoming\u00a0<\/span><a class=\"storyTags\" style=\"color: #0000ff !important;\" href=\"https:\/\/www.business-standard.com\/search?type=news&amp;q=State+Assembly\" target=\"_blank\">state assembly<\/a><span style=\"color: #000000;\">\u00a0elections.
