{"id":36054,"date":"2014-12-02T16:57:59","date_gmt":"2014-12-02T11:27:59","guid":{"rendered":"https:\/\/www.legalindia.in\/news\/?p=36054"},"modified":"2014-12-02T16:57:59","modified_gmt":"2014-12-02T11:27:59","slug":"police-aspirants-must-impeccable-character-integrity-sc","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/news\/police-aspirants-must-impeccable-character-integrity-sc","title":{"rendered":"Police aspirants must have impeccable character&#038; integrity: SC"},"content":{"rendered":"<p>he <span style=\"color: #0066cc;\">Supreme Court <\/span>has held that a person with criminal antecedents should not be allowed to enter the police force, even if he or she is acquitted or discharged.<br id=\"ms__id911\" \/><br id=\"ms__id912\" \/> A bench headed by Justice T S Thakur said, &#8220;Persons who are likely to erode the credibility of the police ought not to enter the police force.&#8221;<br id=\"ms__id913\" \/><br id=\"ms__id914\" \/> &#8220;Even if he is acquitted or discharged, it cannot be presumed that he was completely exonerated,&#8221; the bench said, adding that a person having criminal antecedents will not fit in the category.<br id=\"ms__id915\" \/><br id=\"ms__id916\" \/> &#8220;It is clear that a candidate to be recruited to the police service must be worthy of confidence and must be a person of utmost rectitude and must have impeccable <span style=\"color: #0066cc;\">character <\/span>and integrity,&#8221; the bench also comprising Justice Adarsh Kumar Goel said.<br id=\"ms__id918\" \/><br id=\"ms__id919\" \/> The bench allowed the appeal filed by Madhya Pradesh government against High Court&#8217;s order asking it to consider the case of one Parvez Khan for appointment in police service within three months on compassionate grounds.<br id=\"ms__id920\" \/><br id=\"ms__id921\" \/> Khan had applied for police job on compassionate grounds following the death of his father Sultan Khan, who served in Madhya Pradesh police.<br id=\"ms__id922\" \/><br id=\"ms__id923\" \/> During police verification it was found that Khan was involved in two criminal cases &#8211; one pertaining to<a href=\"https:\/\/i0.wp.com\/www.legalindia.in\/news\/wp-content\/uploads\/2014\/12\/police-aspirants.png?ssl=1\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" data-attachment-id=\"36055\" data-permalink=\"https:\/\/www.legalindia.com\/news\/police-aspirants-must-impeccable-character-integrity-sc\/police-aspirants\" data-orig-file=\"https:\/\/i0.wp.com\/www.legalindia.com\/news\/wp-content\/uploads\/sites\/2\/2014\/12\/police-aspirants.png?fit=288%2C175&amp;ssl=1\" data-orig-size=\"288,175\" data-comments-opened=\"1\" data-image-meta=\"{&quot;aperture&quot;:&quot;0&quot;,&quot;credit&quot;:&quot;&quot;,&quot;camera&quot;:&quot;&quot;,&quot;caption&quot;:&quot;&quot;,&quot;created_timestamp&quot;:&quot;0&quot;,&quot;copyright&quot;:&quot;&quot;,&quot;focal_length&quot;:&quot;0&quot;,&quot;iso&quot;:&quot;0&quot;,&quot;shutter_speed&quot;:&quot;0&quot;,&quot;title&quot;:&quot;&quot;,&quot;orientation&quot;:&quot;0&quot;}\" data-image-title=\"police aspirants\" data-image-description=\"\" data-image-caption=\"\" data-large-file=\"https:\/\/i0.wp.com\/www.legalindia.com\/news\/wp-content\/uploads\/sites\/2\/2014\/12\/police-aspirants.png?fit=288%2C175&amp;ssl=1\" class=\"alignright size-full wp-image-36055\" src=\"https:\/\/i0.wp.com\/www.legalindia.in\/news\/wp-content\/uploads\/2014\/12\/police-aspirants.png?resize=288%2C175&#038;ssl=1\" alt=\"police aspirants\" width=\"288\" height=\"175\" srcset=\"https:\/\/i0.wp.com\/www.legalindia.com\/news\/wp-content\/uploads\/sites\/2\/2014\/12\/police-aspirants.png?w=288&amp;ssl=1 288w, https:\/\/i0.wp.com\/www.legalindia.com\/news\/wp-content\/uploads\/sites\/2\/2014\/12\/police-aspirants.png?resize=150%2C91&amp;ssl=1 150w\" sizes=\"auto, (max-width: 288px) 100vw, 288px\" \/><\/a> assault and criminal intimidation, and the other of house trespass and dacoity.<br id=\"ms__id924\" \/><br id=\"ms__id925\" \/> In the first case Khan was acquitted while in the second case he was discharged on account of compounding of offence.<br id=\"ms__id926\" \/><br id=\"ms__id927\" \/> The apex court held that, &#8220;Even after acquittal, basis of order of the court has to be gone into by competent authority. Even after order based on compromise or lack of evidence may render a candidate ineligible.&#8221;<br id=\"ms__id928\" \/><br id=\"ms__id929\" \/> Taking into account the report of Superintendent of Police, who held Khan ineligible for appointment in police force, the bench said in the present case &#8216;Superintendent of Police is the appointing authority&#8217; and there was &#8216;no material to show that Khan was falsely implicated&#8217;.<br id=\"ms__id930\" \/><br id=\"ms__id931\" \/> Setting aside the order of division bench of the High Court, the apex court said, &#8220;Refusal by competent authority to recruit the respondent (Khan) on the ground of criminal antecedents is not liable to be interfered with.&#8221;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>he Supreme Court has held that a person with criminal antecedents should not be allowed to enter the police force, even if he or she is acquitted or discharged.
