The city government on Thursday moved the Delhi High Court against its single judge order quashing the points system for nursery admission brought in by the Lieutenant Governor (LG) for private unaided schools here.<\/p>\n
The single judge had passed order while disposing of two petitions by a committee and a forum representing the private schools which had challenged the LG\u2019s December 18 and December 27 notifications of last year by which the points system was introduced. Contending that the order passed by the single judge is \u201ctotally wrong\u201d, \u201cerroneous\u201d and \u201cagainst the law\u201d, the Delhi government petition has said that verdict has not appreciated the correct legal position and scheme of Article 21 and Article 21-A besides laying undue emphasis on the right of schools. \u201cThe judge erred to hold that if parents are given freedom to choose school, the good schools would attract more students and would expand and not-so-good schools would lose students,\u201d the plea said. It contended that there cannot be any discrimination, question of autonomy in the matter of admitting children around 3 years of age in nursery. \u201cThe judge has failed to consider that education is a paramount consideration for the welfare of the society and in this, there are several participants\u2026\u201dQuash and set aside the impugned judgement dated November 28 with all consequential benefits and reliefs,\u201d it pleaded to the court. Earlier, an NGO had moved the High Court against the single judge order on the ground that the judge has erred in law in not appreciating the arguments that there is no question of schools\u2019 autonomy in the matter of admissions of tiny tots.<\/p>\n","protected":false},"excerpt":{"rendered":"
