{"id":36090,"date":"2014-12-05T23:29:53","date_gmt":"2014-12-05T17:59:53","guid":{"rendered":"https:\/\/www.legalindia.in\/news\/?p=36090"},"modified":"2014-12-05T23:29:53","modified_gmt":"2014-12-05T17:59:53","slug":"sc-rejects-plea-restraining-jailbirds-contesting-poll","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/news\/sc-rejects-plea-restraining-jailbirds-contesting-poll","title":{"rendered":"SC rejects plea on restraining jailbirds from contesting poll"},"content":{"rendered":"<p>The Supreme <span style=\"color: #0066cc;\">Court <\/span>today dismissed a plea challenging an amendment in Representation of People&#8217;s Act allowing jailbirds, except convicts, to contest elections, which was earlier barred by it. <br id=\"ms__id1167\" \/><br id=\"ms__id1168\" \/> &#8220;If there is conviction and sentence, we can understand but the registration of an FIR and confinement is not sufficient to bar a person from contesting election,&#8221; a bench headed by Chief Justice<span style=\"text-decoration: underline;\"> <span style=\"color: #0066cc; text-decoration: underline;\">H <\/span><\/span><span style=\"color: #0066cc;\">L <\/span><span style=\"color: #0066cc;\">Dattu <\/span>said. <br id=\"ms__id1170\" \/><br id=\"ms__id1171\" \/> The bench refused to entertain an appeal filed against <span style=\"color: #0066cc;\">Delhi <\/span>High Court&#8217;s order passed on February 6 by which it had upheld the constitutional validity of the amendment. <br id=\"ms__id1173\" \/><br id=\"ms__id1174\" \/> The High Court had observed that not allowing an arrested accused or an undertrial to contest <span style=\"color: #0066cc;\">election <\/span>on the ground that he has no right to vote while incarcerated &#8220;would leave the door open for vendetta politics&#8221;. <br id=\"ms__id1176\" \/><br id=\"ms__id1177\" \/> &#8220;Extending curtailment of the right to vote of a person in prison to the right to stand in election would, in our opinion, leave the door open for practice of &#8216;vendetta politics&#8217; by ruling parties. <br id=\"ms__id1178\" \/><br id=\"ms__id1179\" \/> &#8220;All that a politician\/ruling party-in-power would need to do to prevent rivals from contesting an election is to ask the police to file a case and to arrest the rivals,&#8221; it had said. <br id=\"ms__id1180\" \/><br id=\"ms__id1181\" \/> The Supreme Court had on July 10 last year ruled under the existing law that a person, who is in jail or in police custody, cannot contest election to legislative bodies. <br id=\"ms__id1182\" \/><br id=\"ms__id1183\" \/> The Centre thereafter amended the Act allowing people in confinement to contest election.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Supreme Court today dismissed a plea challenging an amendment in Representation of People&#8217;s Act allowing jailbirds, except convicts, to contest elections, which was earlier barred by it. &#8220;If there is conviction and sentence, we can understand but the registration of an FIR and confinement is not sufficient to bar a person from contesting election,&#8221;
