{"id":36257,"date":"2014-12-19T09:09:29","date_gmt":"2014-12-19T03:39:29","guid":{"rendered":"https:\/\/www.legalindia.in\/news\/?p=36257"},"modified":"2014-12-19T09:09:29","modified_gmt":"2014-12-19T03:39:29","slug":"mp-hc-judge-divested-administrative-supervisory-role-sc","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/news\/mp-hc-judge-divested-administrative-supervisory-role-sc","title":{"rendered":"MP HC judge be divested of administrative and supervisory role: SC"},"content":{"rendered":"<div id=\"ms__id846\"><strong id=\"ms__id847\">The Supreme Court today asked the Chief Justice of Madhya Pradesh High Court to divest one of his colleagues, accused of sexually harassing a former woman Additional District and Sessions Judge (ADSJ), from undertaking all administrative and supervisory functions.<\/strong><\/div>\n<div id=\"ms__id848\"><\/div>\n<div id=\"ms__id850\">A bench headed by Justice J S Khehar also held that the Chief Justice of the MP High Court travelled beyond his jurisdiction by constituting a two-judge committee to look into the allegations of the woman subordinate judge.<br id=\"ms__id851\" \/><br id=\"ms__id852\" \/><\/div>\n<div id=\"ms__id853\">&#8220;The Chief Justice of Madhya Pradesh High Court, in the present case, travelled beyond the jurisdiction. The two-judge committee should have been formed at the second stage of investigation,&#8221; it said.<br id=\"ms__id854\" \/><br id=\"ms__id855\" \/><\/div>\n<div id=\"ms__id856\">The bench also said that the second stage of in-house inquiry proceedings have to be commenced by the Chief Justice of India.<br id=\"ms__id857\" \/><br id=\"ms__id858\" \/><\/div>\n<div id=\"ms__id859\">It said that &#8220;to ensure the fair and just inquiry, it is imperative to divest respondent number 3 (the judge concerned)&#8221; of supervisory and administrative functions.<br id=\"ms__id860\" \/><br id=\"ms__id861\" \/><\/div>\n<div id=\"ms__id862\">The apex court said that the Chief Justice of India may re-initiate the in-house proceedings or may ask the Chief Justice of other high court to do the same.<br id=\"ms__id863\" \/><br id=\"ms__id864\" \/><\/div>\n<div id=\"ms__id865\">Earlier, the apex court had restrained the media from covering the proceedings in the case. It, however, had said that the judgement can be reported.<br id=\"ms__id866\" \/><br id=\"ms__id867\" \/><\/div>\n<div id=\"ms__id868\">The Supreme Court had on August 29 stayed an August 8 order of the Chief Justice of Madhya Pradesh High Court setting up a judicial panel to probe the allegations levelled by the former woman judge.<br id=\"ms__id869\" \/><br id=\"ms__id870\" \/><\/div>\n<div id=\"ms__id871\">The former Gwalior judge, who had resigned alleging sexual harassment by the HC judge, had moved the apex court raising questions over the judicial panel to look into her complaint.<br id=\"ms__id872\" \/><br id=\"ms__id873\" \/><\/div>\n<div id=\"ms__id874\">In her plea, she had said that her resignation is a &#8220;constructive termination&#8221; and she be reinstated with all consequential benefits.<br id=\"ms__id875\" \/><br id=\"ms__id876\" \/><\/div>\n<div id=\"ms__id877\">She had said the HC order of August 8 constituting a judicial panel should be quashed as she felt it will not do justice to her.
