A Motor Accident Claims Tribunal (MACT) here has awarded over Rs 14 lakh compensation to the family members of a 34-year-old man, who died in a road mishap involving a rashly driven bike.<\/p>\n
The tribunal directed the National Insurance Company Ltd, insurer of the bike, to pay Rs 14,68,024 as compensation to the mother, wife and minor son of Surender Singh, who suffered fatal injuries in the accident in 2011 due to the negligence of rider Vikash Kumar.<\/p>\n
While relying on the testimony of the victim’s wife and an eyewitness, MACT Presiding Officer Sanjeev Kumar Singh said, “The cross-examination carried on by the respondents (Kumar and insurance company) is not suggestive of anything which may discard the claim of petitioners that the driver of the bike was rash and negligent…”<\/p>\n
The tribunal also relied on the post mortem report, FIR against the rider and other documents while deciding the case in the favour of victim’s family.<\/p>\n
According to the petition, on August 4, 2011, Singh was going to his residence in Kashmere Gate here from Saket on the bike being ridden by Kumar rashly and negligently.<\/p>\n
Despite being requested and warned, Kumar did not slow down and continued to ride carelessly without caring for traffic norms, it said.<\/p>\n
Around 9.15 PM, when the motorcycle reached ITO flyover here, suddenly Kumar lost control and the bike fell down on the road, due to which, both the riders sustained grievous injuries but Singh succumbed to death.<\/p>\n
The family members of Singh lodged an FIR against Kumar for causing death by negligence, and sought compensation of Rs 25 lakh from the tribunal for the victim’s untimely death.<\/p>\n
During the proceedings, Kumar denied the allegations of negligence on his part and claimed that all contents of the petition were false<\/p>\n","protected":false},"excerpt":{"rendered":"
