{"id":36531,"date":"2015-01-15T15:41:17","date_gmt":"2015-01-15T10:11:17","guid":{"rendered":"https:\/\/www.legalindia.in\/news\/?p=36531"},"modified":"2015-01-15T15:41:17","modified_gmt":"2015-01-15T10:11:17","slug":"kids-woman-accident-victim-get-rs-69-l-compensation","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/news\/kids-woman-accident-victim-get-rs-69-l-compensation","title":{"rendered":"Kids of woman accident victim get over Rs 69 L compensation"},"content":{"rendered":"<p><span style=\"color: #000000; font-family: Calibri; font-size: medium;\">Two minor children of a 32-year-old woman, who died in a road accident in 2012, have been awarded a compensation of over Rs 69 lakh by a Motor Accident Claims Tribunal (MACT) here. <br id=\"ms__id1181\" \/> <br id=\"ms__id1182\" \/> MACT Presiding Officer Deepak Jagotra, while noting that victim&#8217;s husband (petitioner) expired during pendency of the proceedings, directed the National <\/span><a id=\"ms__id1183\" href=\"https:\/\/www.business-standard.com\/search?type=news&amp;q=Insurance\" target=\"_blank\"><span style=\"color: #0000ff; font-family: Calibri; font-size: medium;\">Insurance <\/span><\/a><span style=\"color: #000000; font-family: Calibri; font-size: medium;\">Company to pay Rs 69,28,728 to their minor son and daughter, after they attain majority. <br id=\"ms__id1185\" \/> <br id=\"ms__id1186\" \/> While awarding the compensation, the tribunal relied on the testimony of the woman&#8217;s husband during the proceedings that he was riding a scooter on which his wife was sitting pillion when a negligently driven <\/span><a id=\"ms__id1187\" href=\"https:\/\/www.business-standard.com\/search?type=news&amp;q=Hyundai\" target=\"_blank\"><span style=\"color: #0000ff; font-family: Calibri; font-size: medium;\">Hyundai <\/span><\/a><span style=\"color: #000000; font-family: Calibri; font-size: medium;\">i20 car hit them from behind leading to her death. <br id=\"ms__id1188\" \/> <br id=\"ms__id1189\" \/> &#8220;It is amply clear that the car driver must have easily seen as to who is going ahead of him. Testimony of victim&#8217;s husband is absolutely believable and has not been discredited by the respondents (driver and insurance company),&#8221; it said. <br id=\"ms__id1190\" \/> <br id=\"ms__id1191\" \/> &#8220;Since the victim&#8217;s husband has also expired, his share will be divided into his children and his mother,&#8221; it added. <br id=\"ms__id1192\" \/> <br id=\"ms__id1193\" \/> The tribunal also relied on the documents including FIR, chargesheet, mechanical inspection report and post mortem report of the victim while deciding the case in favour of the victim&#8217;s family members. <br id=\"ms__id1194\" \/> <br id=\"ms__id1195\" \/> During the pendency of proceedings the tribunal had, in February 2013, awarded an interim compensation Rs 50,000 to the family of the victim.<\/span><\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Two minor children of a 32-year-old woman, who died in a road accident in 2012, have been awarded a compensation of over Rs 69 lakh by a Motor Accident Claims Tribunal (MACT) here.
