Celebratory firing of arms during\u00a0marriage processions is proving to be a killer for innocent\u00a0people and there is a need to tighten the procedure for grant\u00a0of arms licence and also ensure that it is not misused, a\u00a0Delhi court has observed.<\/p>\n
Additional Sessions Judge Manoj Jain made the observation\u00a0while handing down a 25-month jail term to 35-year-old Jasbir\u00a0Chauhan, who fired in the air at his friend\u2019s wedding in\u00a0Burari area here, killing the groom\u2019s uncle.<\/p>\n
\u201cFiring with guns and pistols during marriage processions\u00a0has become a sort of fashion. If this is happening in the\u00a0capital city, it will be certainly in a larger proportion in\u00a0rural or remote areas,\u201d said the court.<\/p>\n
\u201cThis is proving to be a killer for innocent fellow-\u00a0baraatis and even on-lookers. It\u2019s high time that government\u00a0tightens the procedure for grant of arms-licence and also\u00a0evolves a robust mechanism to ensure that these licences are\u00a0not misused,\u201d the judge said.
\nBesides the jail term, the court also imposed a fine of Rs\u00a0three lakh on the convict, directing that it be paid to the\u00a0victim\u2019s wife.<\/p>\n
\u201cSuch an act of firing was not evidently intentional but\u00a0he certainly had knowledge that he was holding a dangerous\u00a0 weapon. It was a loaded one. He was not firing in any deserted\u00a0place. It was rather a marriage procession\u2026\u201d it said.<\/p>\n
The court also observed that some guests, to show-off and\u00a0unnecessarily demonstrate their jubilation, \u201ctake pride in\u00a0 firing in air\u201d from their licensed fire-arms which they feel\u00a0to be their prized possession.<\/p>\n
\u201cLittle do they realise that such a thing is neither\u00a0desirable nor legal and can also kill someone. This is what\u00a0precisely happened in the case in hand,\u201d it said.<\/p>\n
While awarding the punishment, the court said that though\u00a0the act was not intentional, Jasbir had knowledge that it\u00a0 could kill someone.<\/p>\n
\u201cKeeping in mind the facts and circumstances of the case,\u00a0I hereby sentence the convict to undergo rigorous imprisonment\u00a0for 25 months under Section 304(II) (culpable homicide without\u00a0intention but with knowledge of consequences of act) of IPC\u00a0and he would deposit Rs three lakh in court as compensation,\u201d\u00a0it said.<\/p>\n
According to the prosecution, on January 21, 2012, at the\u00a0marriage procession of his friend, Jasbir had fired in\u00a0celebration with the bullet hitting the groom\u2019s uncle, Ranbir,\u00a0who died before reaching the hospital.<\/p>\n","protected":false},"excerpt":{"rendered":"
