{"id":38603,"date":"2015-08-07T10:57:48","date_gmt":"2015-08-07T10:57:48","guid":{"rendered":"https:\/\/www.legalindia.com\/news\/?p=38603"},"modified":"2015-08-07T10:58:23","modified_gmt":"2015-08-07T10:58:23","slug":"bus-drivers-expected-to-be-vigilant-of-persons-delhi-court","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/news\/bus-drivers-expected-to-be-vigilant-of-persons-delhi-court","title":{"rendered":"Bus drivers expected to be vigilant of persons : Delhi Court"},"content":{"rendered":"<figure id=\"attachment_37805\" aria-describedby=\"caption-attachment-37805\" style=\"width: 281px\" class=\"wp-caption alignright\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" data-attachment-id=\"37805\" data-permalink=\"https:\/\/www.legalindia.com\/news\/4-years-jail-to-24-year-old-youth-for-stabbing-man\/jail-2\" data-orig-file=\"https:\/\/i0.wp.com\/www.legalindia.com\/news\/wp-content\/uploads\/sites\/2\/2015\/06\/jail.jpg?fit=281%2C180&amp;ssl=1\" data-orig-size=\"281,180\" data-comments-opened=\"1\" data-image-meta=\"{&quot;aperture&quot;:&quot;0&quot;,&quot;credit&quot;:&quot;&quot;,&quot;camera&quot;:&quot;&quot;,&quot;caption&quot;:&quot;&quot;,&quot;created_timestamp&quot;:&quot;0&quot;,&quot;copyright&quot;:&quot;&quot;,&quot;focal_length&quot;:&quot;0&quot;,&quot;iso&quot;:&quot;0&quot;,&quot;shutter_speed&quot;:&quot;0&quot;,&quot;title&quot;:&quot;&quot;,&quot;orientation&quot;:&quot;0&quot;}\" data-image-title=\"jail\" data-image-description=\"\" data-image-caption=\"\" data-large-file=\"https:\/\/i0.wp.com\/www.legalindia.com\/news\/wp-content\/uploads\/sites\/2\/2015\/06\/jail.jpg?fit=281%2C180&amp;ssl=1\" class=\"wp-image-37805 size-full\" src=\"https:\/\/i0.wp.com\/www.legalindia.com\/news\/wp-content\/uploads\/sites\/2\/2015\/06\/jail.jpg?resize=281%2C180&#038;ssl=1\" alt=\"Bus drivers expected to be vigilant of persons : Delhi Court\" width=\"281\" height=\"180\" \/><figcaption id=\"caption-attachment-37805\" class=\"wp-caption-text\">Bus drivers expected to be vigilant of persons : Delhi Court<\/figcaption><\/figure>\n<p>A bus driver, convicted of causing death of a person by negligent driving over a decade ago, has been sent to jail by a Delhi court which observed that such incidents are on the rise and the courts can&#8217;t be oblivious to social responsibility.<\/p>\n<p>The court, while holding bus driver Surendra Kumar guilty under sections 279(rash driving) and 304A (causing death by negligence) of IPC, said that being a bus driver he was also expected to be vigilant of the persons on the road.<\/p>\n<p>&#8220;It&#8217;s been observed that incidents of fatal accidents are on the rise and this court can&#8217;t be oblivious to its social responsibility,&#8221; Additional Chief Metropolitan Magistrate Sharad Gupta said.<\/p>\n<p>The court also said that Kumar was driving his bus in the &#8220;wrong lane&#8221; and did not care to ensure that no person was in front of his bus. &#8220;The accused was thus rash and negligent in driving his bus,&#8221; it said.<\/p>\n<p>&#8220;His vehicle was a bus and was to be driven in the bus lane on the extreme left side of the road&#8230;Being a bus driver he was expected to be vigilant of the persons on road around bus especially when there was a bus stand near the spot and the possibility of people coming on the road or near the bus could not be ruled out,&#8221; it said.<\/p>\n<p>The court, while sentencing him to one year in jail, also imposed a fine of Rs 25,000 which shall be paid as compensation to the family members of the victim.<\/p>\n<p>It also referred to the District Legal Service Authority (DLSA) for grant of appropriate compensation to victim&#8217;s kin.<\/p>\n<p>Kumar was, however, granted bail by the court to appeal in higher court against the verdict.<\/p>\n<p>According to prosecution on August 17, 2002 at Bhajanpura Chowk in east Delhi, Kumar was found driving a bus in a rash and negligent manner and rammed into one Yogesh Kumar resulting in his death.<\/p>\n<p>The driver was caught by a policeman on duty who had seen him trying to flee after the accident.<\/p>\n<p>The court refused to accept the defence of Kumar that one of the cops who had supported the prosecution case, had turned hostile during his cross-examination.<\/p>\n<p>&#8220;The cross examination of the witness took place about 13 years after the incident.
