New Delhi, The Tamil Nadu government has submitted its report to the Supreme Court collegium on Karnataka High Court Chief Justice P D Dinakaran, who is facing allegations of corruption and land grabbing and whose fate hinges on the findings of the report.<\/p>\n
Justice Dinakaran is among five judges who had been recommended by the Supreme Court collegium headed by Chief Justice of India K G Balakrishnan, for elevation to the apex court.<\/p>\n
The SC collegium decided to reconsider its decision regarding the elevation of Justice Dinakaran to Supreme Court, when eminent jurists, including two former Union Law Ministers Shanti Bhushan, Ram Jethmalani and leading lawyer S S Nariman, former Attorney General Ashok Desai and Anil Diwan, wrote letters to President Pratibha Patil, Prime Minister Manmohan Singh, Chief Justice of India K G Balakrishnan and Union Law Minister M Veerappa Moily, not to elevate Justice Dinakaran to the Supreme Court in view of the serious allegations of corruption levelled against him, including acquisition of 450 acres of land in violation of Tamil Nadu Land Sealing Act, which permits maximum of 15 acres of land for a family of five members.<\/p>\n
The SC collegium met yesterday to consider the report of Tamil Nadu government and sought the response of Justice Dinakaran to the report which is reportedly against him.<\/p>\n
The SC collegium is now likely to recommend to the Union Government to clear the names of four other judges, who have been recommended for elevation to the Supreme Court and the judges recommended include Justices A K Patnaik, S S Nijjar, T S Thakur and K S Radhakrishnan.<\/p>\n
The report of the SC collegium, which is likely to put Justice Binakaran in the dock, may also threaten his present position and he may find it difficult to continue as a High Court judge.<\/p>\n
The SC collegium, which is likely to send its new recommendation to Union Law Minister within a day or two recommending to the government not to elevate Justice Dinakaran to the Supreme Court may also appoint a committee of three members to look into the allegations of corruption against Justice Dinakaram, which may be the beginning of impeachment proceedings against him.<\/p>\n
The Chairman of National SC\\ST Commission, Buta Singh, who himself is the under CBI scanner in a bribery case, tried to give the controversy a caste colour when he publicly said a vilification campaign has been launched against CJI and Justice Dinakaran because both are Dalits and has called Shanti Bhushan a ‘casteist’.<\/p>\n
