The court had on December 3, 2015 allowed the plea of\u00a0advocate and complainant Vivek Garg, who had sought permission\u00a0to examine two officials of Delhi Assembly and one Election\u00a0Commission officer as witnesses in support of his complaint.<\/p>\n<p>The court was hearing a complaint filed by Garg alleging\u00a0that the MLA from Model Town constituency had committed an\u00a0offence by getting his mother\u2019s medical allowance reimbursed\u00a0from Delhi government, despite his parents not being dependent\u00a0on him and not entitled to the claims.<\/p>\n<p>On November 4, 2015, the Delhi Police had told the court\u00a0that the AAP leader had returned the money to the Assembly\u00a0secretariat. In its status report, the police had told the court that\u00a0Tripathi was interrogated and he stated that when he came to know that his father, being a pensioner, was not entitled to\u00a0medical claim, he wrote a letter to the Assembly secretariat\u00a0to know the rules and was asked to return the amount with\u00a0interest, that is, around Rs two lakh on September 16.<\/p>\n<p>Garg had told the court that the MLA accepted his crime by\u00a0returning the money and now there was no need to lodge an FIR\u00a0and he be directly put on trial. In his complaint, Garg had claimed that Tripathi, in two\u00a0affidavits filed before the Election Commission during the\u00a02013 and 2015 Assembly polls, had declared that his parents\u00a0were not dependent on him.<\/p>\n<p>He alleged that Tripathi had obtained a medical facility\u00a0card under Delhi Government Employees Health Scheme and to\u00a0obtain \u201cwrongful gains\u201d, he has disclosed in the card that his\u00a0parents are dependent on him and can avail medical facility on\u00a0the card of an MLA.
