{"id":53160,"date":"2018-06-17T12:59:41","date_gmt":"2018-06-17T07:29:41","guid":{"rendered":"https:\/\/www.legalindia.com\/news\/?p=53160"},"modified":"2018-06-17T12:59:41","modified_gmt":"2018-06-17T07:29:41","slug":"madras-hc-refused-to-quash-case-against-couple-in-land-grabbing","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/news\/madras-hc-refused-to-quash-case-against-couple-in-land-grabbing","title":{"rendered":"Madras HC refused to quash case against couple in land grabbing"},"content":{"rendered":"<p><b>Chennai:\u00a0<\/b>The Madras High Court has denied to quash criminal proceedings against a couple in a case of alleged land grabbing in Puducherry, observing that they were part of a gang which targeted rich French nationals to usurp their properties by forging documents.<\/p>\n<p><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-3844 alignleft\" src=\"https:\/\/i0.wp.com\/www.wakeuppost.com\/wp-content\/uploads\/2018\/06\/Madras_High_Court_PTI-300x186.jpg?resize=300%2C186&#038;ssl=1\" alt=\"\" width=\"300\" height=\"186\" \/>Justice P N Prakash, dismissing petitions by the couple, directed a judicial magistrate court in Puducherry, a former French colony, to go ahead with the case, saying there was sufficient material against the two for framing charges.<br \/>\n&#8220;&#8230;the accused in this case are not simple people, but belong to a gang which identifies rich French nationals with huge properties in Puducherry and usurps them by creating fake documents,&#8221; the judge pointed out in his order, citing arguments during the hearing.<\/p>\n<p>The judge said if the accused do not co-operate, they can be remanded to custody.<br \/>\nThe case was filed on a complaint from Marie Jacques that her father Saint Jacques Antoine&#8217;s properties across Puducherry was grabbed by using fake documents after he was killed in 2006.<br \/>\nBased on her complaint, the police registered a case against 16 people, including the couple &#8212; K Elumalai and E Karpagam &#8212; and filed a final report before the Judicial Magistrate-II, Puducherry.<br \/>\nJustice Prakash also wondered how the quash petitions were allowed to be filed without impleading Marie Jacques, the original complainant, as respondent.
