The reason as disclosed was that he had acquired some\u00a0liking for her and was disturbed of the fact of her getting married. The incident had two eye witnesses which gave statements against the convict and confirmed the fact that he was the one who committed the crime.<\/p>\n<p>The\u00a0deceased\u00a0died\u00a0immediately\u00a0after\u00a0lodging\u00a0FIR to which the Court examined whether the same is admissible in evidence as dying declaration. The Court took notice of cases such as\u00a0Dharam\u00a0Pal\u00a0&amp;\u00a0Ors.\u00a0Vs.\u00a0State\u00a0of\u00a0UP\u00a0{AIR\u00a02008\u00a0SUPREME\u00a0COURT 920},\u00a0wherein\u00a0the\u00a0Supreme\u00a0Court\u00a0has\u00a0observed\u00a0thus\u00a0in\u00a0Para\u00ad10:\u00ad<\/p>\n<p>Similar observation has been made by Karnataka High Court in\u00a0Ismail\u00a0Vs.\u00a0State\u00a0of\u00a0Karnataka\u00a0{2000 CRI.L.J.\u00a01994}.Learned\u00a0Counsel\u00a0for\u00a0the\u00a0appellant\u00a0would\u00a0submit\u00a0that the\u00a0act\u00a0of\u00a0the\u00a0appellant\u00a0would\u00a0not\u00a0amount\u00a0to\u00a0culpable\u00a0homicide but it would amount\u00a0to culpable homicide not amounting to murder\u00a0and\u00a0at\u00a0best,\u00a0the\u00a0offence\u00a0would\u00a0fall\u00a0under\u00a0Section\u00a0304 Part\u00adI\u00a0of\u00a0the\u00a0IPC\u00a0and\u00a0not\u00a0under\u00a0Section\u00a0302\u00a0of\u00a0the\u00a0IPC.\u00a0\u00a0He\u00a0would refer\u00a0 to\u00a0 the \u00a0judgment \u00a0rendered \u00a0by \u00a0the \u00a0Supreme \u00a0Court\u00a0in\u00a0the matter\u00a0of Lavghanbhai\u00a0Devjibhai\u00a0Vasava\u00a0Vs.\u00a0State\u00a0of\u00a0Gujarat {(2018)\u00a04\u00a0SCC\u00a0329}.<\/p>\n<p>The Court took notice of the fact that the\u00a0appellant\u00a0has\u00a0inflicted\u00a0one\u00a0single\u00a0blow\u00a0over\u00a0the\u00a0neck\u00a0of\u00a0the deceased which means he\u00a0has\u00a0not\u00a0acted\u00a0in\u00a0cruel\u00a0or\u00a0unusual\u00a0manner\u00a0in\u00a0the sense\u00a0that\u00a0after\u00a0giving\u00a0one\u00a0blow\u00a0he\u00a0did\u00a0not\u00a0repeat\u00a0the\u00a0blow.
