It is a distinctive mark that enjoys enormous goodwill &amp; reputation in the airline, travel &amp; tourism industry. Use of this mark, even in respect of unrelated services would create confusion &amp; deception. It deserves to be declared as a well-known mark.\u201d<\/p>\n<p>Since 2014, Tata SIA Airlines Ltd, is using the mark \u2018Vistara\u2019 for airline services.<\/p>\n<p>Tata SIA Airlines Ltd, the operator of Vistara Airlines, moved the Court seeking to restrain the aviation portal from selling of \u2018Vistara\u2019 branded products on its website as well as on e-commerce portals like Amazon and\u00a0Snapdeal, following which the court gave this order.<\/p>\n<p>The\u00a0<em><strong><a href=\"https:\/\/www.pilot18.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">https:\/\/www.pilot18.com<\/a><\/strong><\/em>\u00a0claimed before the High Court that they have not used the trademark \u2018Vistara\u2019 &amp; that the airline company has concocted a false story.<\/p>\n<p>A\u00a0Local Commissioner was appointed by the Court to look into the matter, who found a large number of products bearing the mark \u2018Vistara\u2019 being used by the portal. The portal\u2019s owner didn&#8217;t accept the same &amp; claimed themselves to be innocent.<\/p>\n<p>In the given order the Court noted that, \u201ca perusal of the statement (portal\u2019s owner) shows that the plea taken in the written statement was false, i.e., that\u00a0the mark \u2018Vistara\u2019 has not been used by the defendants\u00a0(portal &amp; its owner).
