{"id":59919,"date":"2020-07-01T20:04:22","date_gmt":"2020-07-01T14:34:22","guid":{"rendered":"https:\/\/www.legalindia.com\/news\/?p=59919"},"modified":"2020-07-01T20:04:22","modified_gmt":"2020-07-01T14:34:22","slug":"bombay-high-court-permits-minor-rape-victim-to-terminate-25-week-pregnancy","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/news\/bombay-high-court-permits-minor-rape-victim-to-terminate-25-week-pregnancy","title":{"rendered":"Bombay High Court permits minor rape victim to terminate 25-week pregnancy"},"content":{"rendered":"<p>The Bombay High Court has\u00a0permitted a 17-year-old rape victim to terminate her 25-week pregnancy despite a report submitted by the civic-run KEM Hospital here advising against the abortion.<\/p>\n<p>A division bench of Justices K K Tated and Milind Jadhav gave the order on Tuesday while hearing the girl&#8217;s petition filed through her father, seeking permission to undergo medical termination of her 25-week pregnancy.<\/p>\n<p>As per the plea, the girl is a victim of rape and a case against the perpetrator is lodged at the Vakola police station in Mumbai.<\/p>\n<p>Provisions of the Medical Termination of Pregnancy Act do not permit a woman to terminate pregnancy, if it has crossed 20 weeks and she will have to seek the high courts permission to do so.<a href=\"https:\/\/i0.wp.com\/www.legalindia.com\/news\/wp-content\/uploads\/sites\/2\/2019\/09\/bhc.jpg?ssl=1\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" data-attachment-id=\"57523\" data-permalink=\"https:\/\/www.legalindia.com\/news\/the-bombay-high-court-how-will-a-mobile-app-work-in-communication-hit-jk\/bhc-5\" data-orig-file=\"https:\/\/i0.wp.com\/www.legalindia.com\/news\/wp-content\/uploads\/sites\/2\/2019\/09\/bhc.jpg?fit=301%2C167&amp;ssl=1\" data-orig-size=\"301,167\" data-comments-opened=\"1\" data-image-meta=\"{&quot;aperture&quot;:&quot;0&quot;,&quot;credit&quot;:&quot;&quot;,&quot;camera&quot;:&quot;&quot;,&quot;caption&quot;:&quot;&quot;,&quot;created_timestamp&quot;:&quot;0&quot;,&quot;copyright&quot;:&quot;&quot;,&quot;focal_length&quot;:&quot;0&quot;,&quot;iso&quot;:&quot;0&quot;,&quot;shutter_speed&quot;:&quot;0&quot;,&quot;title&quot;:&quot;&quot;,&quot;orientation&quot;:&quot;0&quot;}\" data-image-title=\"bhc\" data-image-description=\"\" data-image-caption=\"\" data-large-file=\"https:\/\/i0.wp.com\/www.legalindia.com\/news\/wp-content\/uploads\/sites\/2\/2019\/09\/bhc.jpg?fit=301%2C167&amp;ssl=1\" class=\"alignleft size-full wp-image-57523\" src=\"https:\/\/i0.wp.com\/www.legalindia.com\/news\/wp-content\/uploads\/sites\/2\/2019\/09\/bhc.jpg?resize=301%2C167&#038;ssl=1\" alt=\"\" width=\"301\" height=\"167\" srcset=\"https:\/\/i0.wp.com\/www.legalindia.com\/news\/wp-content\/uploads\/sites\/2\/2019\/09\/bhc.jpg?w=301&amp;ssl=1 301w, https:\/\/i0.wp.com\/www.legalindia.com\/news\/wp-content\/uploads\/sites\/2\/2019\/09\/bhc.jpg?resize=150%2C83&amp;ssl=1 150w, https:\/\/i0.wp.com\/www.legalindia.com\/news\/wp-content\/uploads\/sites\/2\/2019\/09\/bhc.jpg?resize=300%2C166&amp;ssl=1 300w\" sizes=\"auto, (max-width: 301px) 100vw, 301px\" \/><\/a><\/p>\n<p>The victim, in her plea seeking permission to undergo medical termination of pregnancy, said her mental and physical health is at risk.<\/p>\n<p>The court last week directed the petitioner to appear before the medical board of the KEM Hospital in Mumbai for examination and sought a report from the board.<\/p>\n<p>The board in its report advised against termination and said if the pregnancy is continued, a healthy baby could be delivered and the petitioner and her family could then decide if they want to care of the baby or put him\/her up for adoption.<\/p>\n<p>The board said the petitioner should be able to take care of the baby with psychological support and counselling.<\/p>\n<p>The bench in its order, however, noted that in the present case the pregnancy was caused by rape and hence, there is no doubt that continuance of this pregnancy &#8220;is causing a grave injury to the mental health of the petitioner&#8221;.<\/p>\n<p>Therefore, the court permitted the petitioner to undergo medical termination of the pregnancy.<\/p>\n<p>&#8220;In case the child is born alive during the termination procedure and if the petitioner and her parents are not willing or are not in a position to take responsibility of the baby, then the state government and the agencies concerned will have to assume full responsibility of the child, the court directed.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Bombay High Court has\u00a0permitted a 17-year-old rape victim to terminate her 25-week pregnancy despite a report submitted by the civic-run KEM Hospital here advising against the abortion.
