Court asks MHA to take action against erring senior cops

delhi high court The Home Ministry has been directed by a Delhi court to take disciplinary action against some senior police officers for their “careless attitude and dereliction of duties” in not registering a case and probing into the death of a man, who was found hanging here.

The court noted that the mans mother has been “running from pillar to post” for past two years since his death and even approached the Delhi Police Commissioner but neither the police chief nor DCP of north district took appropriate action on her complaints, except forwarding it to the SHO concerned.

Special judge Brijesh Garg directed registration of FIR at Sarai Rohilla Police station here in connection with the death of Meerut resident Vichal Jain, saying a thorough probe was required to be conducted into his homicidal death.

The court set aside the magisterial courts order and allowed the application of Jains mother seeking lodging of an FIR in the matter and directed the SHO of Sarai Rohilla Police Station to file a compliance report before the trial court.

“A copy of this order be sent to the Secretary (Home), Government of India… for his information and for taking appropriate disciplinary action against the concerned senior officers of the Delhi Police and SHO concerned, as Ministry of Home Affairs, Government of India, is the cadre controlling authority of these senior officers of Delhi Police.

“An action taken report be also submitted by Secretary, Home Affairs, Government of India… to this court, within a period of six weeks,” the court said.

Trishla Jain said in the revision petition that her son was in handicrafts business at Meerut and had come to Delhi on February 8, 2014, to collect payments from his dealers here.

He stayed at a rented room in Shastri Park where he also called a woman who had remained there in the night, the plea said.

The petitioner said that the woman told her that she had left the place in the morning after a fight with Jain and when she came back after some time, she found his body hanging from the fan. PTI
