Court notice to Delhi bar council

The Delhi High Court on Wednesday issued notices to the state bar council and others on a plea for an early election of the Rohini Court Bar Association (RCBA) office bearers.

A bench of Acting Chief Justice A K Sikri and Justice Rajiv Sahai Endlaw asked the the Bar Council of Delhi (BCD), RCBA and others to respond to the plea, filed by two advocates including Piyush Mittal, seeking the bar election for Rohini district courts. The high court fixed the case for next hearing on March 21.

During the hearing, the petitioners alleged the existing RCBA committee, which was elected on January 15, 2010, is continuing in the office by “unauthorisedly” amending the rules of the bar.

“Usually, the tenure of elected Bar committees are for one year, but the present RCBA executives have already completed more than two years in the office,” the petitioners’ counsel said adding the bar associations are part of the judicial system and the plea for its early election must be heard on priority basis.

Earlier, a single judge-bench had transferred the case to the bench of two judges saying the matter involved larger public interest. The petition has challenged the alleged extension of the terms of the executive committee by two years by the bar body.

The PIL also sought a direction to the BCD to restrain the present RCBA office bearers from holding offices and take over the charges of the bar body.

The petitioners also alleged that the terms of the present executive body has expired and the office bearers were “unauthorisedly” holding their posts even after the expiry of the period.
