Supreme Court to hear Nupur, Rajesh Tawlar’s review petition

The Supreme Court will hear in an open court a review plea by Rajesh and Nupur Talwar challenging its decision to allow their prosecution in the 2008 double murder of their daughter Aarushi and domestic help Hemraj.

Usually review applications are disposed of without oral arguments but the court has made exception in this case.

An apex court bench of Justice A.K. Patnaik and Justice Jagdish Singh Khehar in their order Wednesday said that under the rules, an review application is disposed of by circulation without any oral arguments “unless otherwise ordered by the court”.

Having noted that, the court said that it is of the “opinion that it should hear the oral arguments before passing any order on the application for review.

It directed the registry to list the review petition before the court for hearing.

The dentist couple Rajesh and Nupur Talwar had challenged the trial court order rejecting the closure report by the Central Bureau of Investigation (CBI) and directing the investigating agency to make them accused in their daughter Aarushi’s murder.

The apex court bench of bench of justice A.K. Ganguly (now retired) and Justice J.S. Khehar dismissed the Talwar’s plea by the dentist couple had said that there was nothing wrong in the magistrate’s order putting them on trial.

The Talwar’s are facing charges of murder, conspiracy and destruction of evidence.
