Youth given 5 months’ jail term for stealing mobile

A 28-year-old youth has been sentenced by a Delhi court to over 5 months in jail for snatching a mobile phone from a bus passenger.

While sentencing Uttar Pradesh Shahbuddin for the offence, Metropolitan Magistrate Chhavi Kapoor, however, set off his jail term against the 160-day imprisonment already undergone by him during his trial.

“Shahbuddin has remained in judicial custody for a period of 160 days as an undertrial in this matter. It is observed that the convict is a young boy aged about 28 years.

According to the prosecution, the convict and his two other accomplices had snatched complainant Kishan Sahney’s phone on August 23, 2008 afternoon, when he was going towards Sultanpuri in a bus here.”Keeping in mind the past conduct of the convict and the fact that he has a family to bear, I sentence the convict to period already undergone by him as an undertrial,” the court said.

Sahney deposed that he gave a chase to Shahbuddin and nabbed him near Civil Lines with the help of a constable stationed nearby, while two others managed to escape.

During the trial, Shahbuddin had argued before the court that he had been falsely implicated. The court, however, rejected his argument saying he had led no evidence to prove that he was falsely implicated.
