The petitioners are in custody in connection with the case registered under

Sections 302/34 IPC.

Learned counsel for the petitioners submitted that the petitioners have been

falsely implicated in this case; the main allegation of giving fatal Tangi blow is against

Chhotu Singh; the petitioner was not said to be armed with any weapon; from the F.I.R, it

would be evident that there was land dispute between the parties; the same was the

reason for false implication of the petitioners; the petitioners are in custody since July

2010 without any cogent basis; the petitioners are the local permanent residents and

there is no chance of their absconding.

Learned A.P.P opposed the petitioners’ prayer for bail, but has not disputed the

said factual contentions submitted by learned counsel for the petitioners.

Considering the facts and circumstances of the case, the above named three

petitioners are directed to be enlarged on bail on furnishing bail-bond of Rs. 10,000/-

(Ten thousand only) each with two sureties of the like amount each to the satisfaction of

the C.J.M, Gumla in connection with Palkot P. S. Case No. 47/10, corresponding to G.

R. No. 541/10.
