RULE.
Shri Dabhi, learned Additional
Public Prosecutor waives service of notice of Rule on behalf of
respondent No.1. In the facts and circumstances of the case and with
the consent of learned advocates appearing for respective parties,
present application is taken up for final hearing today.
Present
application has been preferred by the applicants – original
petitioners to restore the main Special Criminal Application
No.1876/2011, which came to be dismissed for non-prosecution by this
Court vide order dated 05.08.2011.
Having heard Shri
Chetan Pandya, learned advocate appearing on behalf of the applicants
and on an assurance by him that as and when the main special criminal
application is taken up for admission hearing and/or hearing, he
shall make himself available, present application is allowed and
Special Criminal Application No.1876/2011 is hereby ordered to be
restored to file. Rule is made absolute to the aforesaid extent.
