                                                 ORDER

Shri Hakam Singh, the Appellant has filed 5 separate applications under the 
RTI Act, 2005, on the same matter.

During the hearing it transpired that the case of the Appellant is that he was 
appointed as a teacher in Navyug Public School, by the  NDMC/NSES, New Delhi, 
as part of Special Recruitment Drive of SC ST teachers to fill up posts meant for 
them.       However,   as   the   appointment   has   now   been   terminated,   he   filed 
representation   against   the   termination   of   his   service   about   which   the   former 
Chairman of SC/ST Commission  has also written to the Home Ministry, being the 
Administrative  Ministry   of   the   NDMC.    The   Appellant,   through  his   various  RTI 
applications,   wants   to   know   the   current   status   regarding   the   petition   of   the 
Appellant   for   appointment   and   regularisation   of   teachers   recruited   under   the 
Special Drive of 2005 and 2007.  He also wants to know whether it was correct on 
the part of NDMC/NSES, New Delhi to club recruitment of teachers for backlog 
vacancies with current recruitment conducted on 17.6.2008.   He also wishes to 
know  whether  teachers  can   be   appointed  on   contract   in   a   special   recruitment 
drive, for filling up the backlog vacancies of SC/ST teachers by NDMC/NSES.

    The   Respondent,   on   the   other   hand,   submit   that   the   petition   of   the 
Appellant  had  been  sent  to   NDMC  who  have  informed  that  the  Appellant  was 
recruited on contract basis by NDMC/NSES and the contract period is  now over. 
They further informed that backlog vacancies of SC/ST  Categories  of teachers 
along with current recruitment was taken up in 2008 for regular appointment and 
the   process   has   been   finalised.     They   informed   the   Commission   that   the 
Parliamentary Standing Committee for MHA is also seized with this matter.

After   hearing   the   parties   the   Commission   deems   it   fit   to   direct   the 
Respondent CPIO as follows:

1. Inform   the   Petitioner   of   the   current   status     of   his   petition   for 
considering regular appointment of teachers recruited under Special Drive 2005 
and 2007.

2. Whether the clubbing of backlog vacancies with current recruitment 
done in 2008 is correct.

3. Provide   information/reason   as   per   record   whether   special 
recruitment can be filled on contract basis by NDMC/NSES.

4. Show file notings of Ministry of Home Affairs to the Appellant with 
regard to his representation dated 2.7.2009.

5. As regards the contention of the Respondent that the DOPT is the 
nodal   Ministry   for   appointment   matters   and   only   they   can   provide   requisite 
information on recruitment policy, the Commission directs the CPIO, Ministry of 
Home   Affairs   to   apprise   the   concerned   CPIO,   DOPT   of   the   Commission’s 
directions within 5 days of receipt of this order in so far as it relates to them, to 
provide the requisite information to the Appellant within 15 days of receipt of this 
order 
  
With these observations/directions the matt4er is disposed of.
