This matter came up for hearing through videoconference (VC) on 
04.10.2010   pursuant   to   Commission’s   notice   dated   09.09.2010. 
Appellant was present through his Counsel, while the respondents were 
represented by Shri B. Singh.

2. Appellant’s   RTI­application   dated   16.02.2010   is   in   the   nature   of 
soliciting from the respondents  the resolution of appellant’s outstanding 
grievance.   On 20.06.2007, appellant was allotted a Company Quarters 
No.M­48/5.     On   10.07.2008,   the   previous   occupant   of   this   Quarters 
vacated   it,   but   immediately   thereafter   another   person,   Shri   Leeladhar 
Mahto  illegally  occupied  the  quarters.    As  the  public  authority  failed  to 
evict the illegal occupant, appellant was left holding the allotment order, 
but no quarters.  He wants to get his rightful claim to the quarters through 
the RTI­proceeding.

3. Respondents   stated   during   the   hearing   that   they   had   initiated 
eviction proceedings against the illegal occupant who also happens to be 
an employee of theirs.

4. It is somewhat strange that the quarters allotted by the competent 
authority  to this  appellant  was  occupied by someone  entirely  unrelated

and the public authority seems powerless against him.  The long drawn­
out eviction proceeding is unlikely to fructify soon.

5. Since  the matter  is  not  within  the  ambit  of the  RTI  Act,  it is not 
possible   to   give   any   relief   to   the   appellant   except   to   advise   that   the 
officers concerned may be urged to discharge their duties to give to this 
hapless employee of theirs, his rightful  claim to the quarters allotted to 
him.

6. Appeal is closed. 

7. Copy of this direction be sent to the parties.
