The instant writ petition has been filed for quashing of FIR relating to
Case Crime No. 258/2009 under Sections 420, 406, 506 IPC of Police
Station Ashiyana, district Lucknow.
This Court, while entertaining the instant writ petition, vide order dated
26.8.2009, stayed the arrest of the petitioner in the aforesaid case crime
subject to his co-operation in the investigation, which shall go on.
A short counter affidavit has been filed by learned AGA, wherein in
para-5, it has been stated that the petitioner is not co-operating with the
investigation and as such, the investigation is still pending.
Learned AGA submits that a copy of the counter affidavit has been
served upon learned Counsel for the petitioner on 24.11.2009 but till
date no rejoinder affidavit has been filed by him.
However, in the ends of justice, one week and no more further time is
granted to the learned Counsel for the petitioner for filing rejoinder
affidavit.
List the matter in the next week. Till then, interim order granted earlier
shall remain in operation.
In the meantime, learned AGA will seek fresh instructions about the
present status of the investigation.
