The appeal was admitted by the order dated 21.12.2009. While admitting
the appeal this court directed to release the amount deposited by the
appellant in favour of the claimants as provided in the award subject to to
verification. Sri Sanjiv Kumar holding brief of Sri Rajendra Jaiswal
submits that though in pursuance of the court’s order the office has sent
necessary report to the District Judge for release of dues in favour of the
claimants but the District Judge at his end is not releasing the amount in
compliance of the order passed by this Court. The order dated 21.12.2009
is quite clear that there is no option for the tribunal except to release the
amount.
Let a notice be issued to the District Judge to submit a report within a
week as to why he has not released the amount in question in terms of the
order dated 21.12.2009. The appropriate action on account of non
compliance of the Court’s order may be taken against the District Judge.
List on 29.7.2010.
The Registry shall communicate the order immediately.
