Heard learned counsel for the applicant, learned A.G.A. for the
State and perused the record.
It is submitted by the learned counsel for the applicant that the
applicant is not named in F.I.R. He was not put to identification by
the witness and no looted property has been recovered from the
possession of the applicant.
Learned A.G.A. submitted that at the time of arrest of the
applicant, the complainant reached there and identified the
applicant and thus there was no requirement for holding Test
Identification Parade.
Considering all the facts and circumstances of the case, without
expressing any opinion on merits of the case, I find it to be a fit
case for bail.
Let the applicant namely, Sarvendra Yadav involved in Case
Crime No. 219 of 2009, under Section 392 I.P.C., P.S. Bela,
District Auraiya be released on bail on his furnishing a personal
bond with two sureties each in the like amount to the satisfaction
of the Court concerned.
