Rule.

Mr HJ Nanavati waives service of Rule for respondent No.1. Ms
Maithali Mehta, learned AGP waives service of respondent No.2. In the
facts and circumstances of the case, the application is taken up for
final disposal today.

Since
sufficient cause is shown for the delay of 89 days in filing the
Letters Patent Appeal, the delay is condoned. Rule is made absolute.

The
application accordingly stands disposed of.

Subject
to removal of office objections, the Letters Patent Appeal shall be
