Background
1. The Appellant filed an RTI request dt.18.7.08 with the CPIO, BSNL,
New Delhi. He requested for information against 5 points regarding
training of officers under RTI Act. On not receiving any reply, the
Appellant filed an appeal dt.3.9.08 with the Appellate Authority. The
Appellate Authority replied on 25.9.08 stating that CPIO has sent the
reply on 25.8.08 a copy of which was also enclosed. Not satisfied with
the reply, the Appellant filed a second appeal dt.31.10.08 before the
CIC stating that reply as forwarded by FAA is not correct and
complete. He further stated that he sought information about training
of RTI at their HQ as well as SSA level only and in the present age to
collect these information through fax or e-mail is not a tough task.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner,
scheduled the hearing for February 5, 2009.
3. Mr. Suresh Kumar, DGM(MIS), CPIO, BSNL and Mr. Joginder Kumar,
AGM represented the Public Authority. They arrived at the hearing a
few minutes after the Appellant left after giving his submission to the
Commission.
4. The Appellant’s representative Mr. Bimal Kumar Khemani was present
during the hearing.
Decision
5. The Commission directs the CPIO to transfer the application to the
concerned Training Centres and to provide all available information
within one month of the receipt of this Order.
6. The CPIO also to showcause as to why the RTI application was not
transferred to the relevant CPIOs under 6(3)(1) of the RTI Act. The
response to reach the Commission within 15 days of receipt of the
Order.
5. The appeal is disposed off.
