                         J U D G M E N T

The petitioner was appointed as a full time craft teacher in

the Kelalur U.P. School in a retirement vacancy. The A.E.O,

Thalassery refused to approve the same on the ground that post

was abolished by him on the retirement of the then incumbent

on 31.3.1986. Later on the Government issued order dated

7.11.2006, approving the said appointment. The said order was

challenged by the Manager before this court. While that writ

petition was pending, the then manager expired. The subsequent

manager withdrew the writ petition and the writ petition was

dismissed. Thereafter the headmistress claimed salary of the

petitioner from the periods 30.10.1986 to 12.10.1989 and from

30.12.2008 onwards. The salary arrears of the petitioner for the

other periods was not claimed by the headmistress.

In the above circumstances, the petitioner has filed Ext.P4

petition before the first respondent for disbursal of arrears of

salary due to the petitioner. The petitioner seeks a direction to

W.P.(C). No.1758/2010 2

the first respondent to consider and pass orders on Ext.P4

expeditiously.

I have heard the learned Government Pleader also.

The writ petition is disposed of directing the first respondent

to consider and pass orders on Ext.P4 as expeditiously as

possible at any rate within three months from the date of receipt

of copy of this judgment, after affording an opportunity of being

heard to the petitioner as well as the manager.
