Heard the learned counsel for the applicant and the learned AGA and perused
the record.
The learned counsel for the applicant submitted that the instant case is an out
come of a marital dispute between the applicant and his wife. The allegations
of dowry and harassment have been made in the complaint merely to harass
the applicant. It was next submitted that the applicant’s passport is genuine but
in order to make the case more serious, the complainant made a general
allegation that the applicant’s passport was forged but failed to disclose details
of the passport. In regard to the withdrawal of Rs. 1,00,000/- the learned
counsel for the applicant submitted that the money belongs to the applicant
which was earned by him in Muscat.
There does not appear to be any reasonable ground to believe that the
applicant will tamper with the witnesses or abscond, if released on bail.
Keeping in view the nature of the offence, evidence, complicity of the
accused, the severity of the punishment and submissions of the learned
counsel for the applicant and the learned AGA, I am of the view that the
applicant has made out a case for bail.
Let the applicant Raja Ali involved in case crime No. 424 of 2010 under
sections 498A, 323, 504, 506, 419, 420 IPC and section 3/4 of the Dowry
Prohibition Act, P.S. Thakurganj, District Lucknow be released on bail on his
furnishing a personal bond and two sureties each in the like amount to the
satisfaction of the Chief Judicial Magistrate, Lucknow.
