03. 14.12.2010 Heard the learned counsel for the petitioner and the State.

Robbery of Rs.3, 43,654/- is originally reported by co-

accused Anand kumar as informant. But in course of investigation, it

was found that the money was kept by him (co-accused). Another item

mobile was found in his possession. Petitioner is named by co-accused

Anand kumar and in his mobile; petitioner’s SIM which is standing in

name of his mother is used. Nature of the act of co-accused is not such,

as can be taken for refusal of anticipatory bail petition of this petitioner.

Having regard to the facts and circumstances of the case, in

the event of arrest or surrender within a period of one month from the

date of receipt/production of a copy of this order, the above named

petitioner shall be released on bail on furnishing bail bond of

Rs.10,000/- (ten thousand) with two sureties of the like amount each to

the satisfaction of the Chief Judicial Magistrate, Patna in connection

with Kadamkuan P.S. Case No.55/2010, subject to the conditions as laid

down under section 438(2) of the Code of Criminal Procedure.
