1. Heard.
2. The petitioner, who is a Dalpati, filed this application for a direction to the respondents to consider his case for appointment on the post of Panchayat Sewak after granting him necessary age relaxation, as according to him, while his case remained pending for such appointment he became overage.

The State counsel with reference to counter-affidavit duly affirmed by District Panchayati Raj Officer, Samastipur, has refuted the prayer made by the petitioner on the ground that the case of the petitioner was considered on 9.9.1995 just before he became overage and as there was no vacancy of Panchayat Sewak available until that date he could not be appointed.

Learned counsel for the petitioner with reference to the order dated 27.1.2000, as contained in Annexure-11 to the rejoinder submitted that the Director Panchayati Raj had considered the case of 27 Dalpaties who become overage for grant of age relaxation and many out of them are junior to the petitioner and those 27 Dalpaties after age relaxation have already been appointed as Panchayat Sewaks. He submits that his case should also be first considered for grant of age relaxation and thereafter for appointment on the post of Panchayat Sewak as was done in the case of aforementioned 27 Dalpaties named in letter dated 27.1.2000, Annexure-11, to the rejoinder affidavit.

Under order dated 7.2.2004 this Court allowed two weeks time to the State-respondents to file further reply to the averments made in the rejoinder in regard to the reliance placed by the petitioner over letter dated 27.1.2000, Annexure-11. Learned counsel for the State-respondents have not yet filed any further reply to the said rejoinder and this Court instead of keeping the matter pending to enable the State-respondents to file further reply deems it expedient to direct the petitioner to approach the Director Panchayati Raj by filing a representation wherein he should request the Director Panchayati Raj to consider his case for grant of age relaxation as was done in the case of 27 Dalpaties named in letter dated 27.1.2000, Annexure-11, and thereafter to consider his case for appointment on the post of Panchayat Sewak.

Petitioner in this regard also places reliance over an order of this Court dated 26.7.1986 passed in CWJC No. 6544/1986, Annexure-8, which may also be placed before the Director along with the representation. Let the petitioner file aforesaid representation annexing the copy of this order and the Director should consider the case and dispose of the same by a reasoned order as early as possible, in any case, within two months from the date of receipt production of a copy of this order.
6. This disposes of this application. No cost.
