                                  ORDER

Petitioners, who are accused Nos. 1 to 4 in Crime

No.982/2010 of Kottayam East Police Station for offences

punishable under Sections 354, 294(b), 323 and 341 read with 34

I.P.C., seek anticipatory bail.

2. The learned Public Prosecutor opposed the application

contending inter alia that all the above offences are bailable.

3. Since the offences are bailable offences invocation of

Section 438 Cr.P.C is misconceived. Accordingly, this application

is dismissed without prejudice to the right of the petitioner to

seek regular bail before the Magistrate concerned.
