Heard learned counsel for the applicant and learned AGA for the State.
The present application has been filed for quashing the order dated 30.4.2010
issuing non-bailable warrants against the applicant in Case No. 1234 of 2005,
State Vs. Raj Kumar Sharma arising out of Case Crime No. 2548 of 2003,
under Sections 279, 338, 427 IPC, Police Station Katghar, District
Moradabad.
The explanation has been tendered in the affidavit filed in support of the
application from paragraph 10 onwards. After taking into consideration the
facts and circumstances, the application is disposed of with a direction that the
order issuing non-bailable warrants shall be kept in abeyance for a period of
two weeks. In the aforesaid two weeks, the applicant shall not be taken into
custody pursuant to the order dated 30.4.2010. In the event, the applicant fails
to appear before the court concerned and furnish fresh bail bonds, the order
shall stand discharged.
